Innocent - convicted on a single testimony

The Issue

 

 

It is our sincerest request for help seeking assistance. We are asking for those willing to consider that errors were made, that crucial evidence was disregarded, and Mr. Guest voice was unjustly silenced, to support this call of action.

  Dear Friends, Supporters, and Concerned Citizens. We come before you to share a deeply troubling and unjust story that demands attention.

There is no good way for someone incarcerated to tell their story, innocent or guilty. But how do they get help if not often anyone cares to even know the truth. Does it matter? Do they matter?

We understand the gravity of such a accusation and the immense impact it has on the lives of all parties involved.  However, Shayne is innocent. Shayne admits he made bad decisions, he's guilty of a lot but not guilty of this crime. Does past ignorance, past bad behavior constitute being incarcerated for years for something he did not do.

  Shayne Guest, finds himself entangled in a web of injustice that has shattered his life. He has been accused of a sex crime that he never committed. That although it was said to be consentual, it never took place. Despite the absence of substantial evidence, Shayne was convicted solely on a single testimony, resulting in a sentence of 40 years and 20 years suspended, despite the initial offer of a 1 year plea deal.

  His alibi, account of his whereabouts, was disregarded. Shayne's voice, his pleas for justice, were dismissed and disregarded in a courtroom where the scales of justice seemingly tipped against him. In this unsettling turn of events, we witness the erosion of trust in a system meant to uphold truth and fairness.

  But it does not end there. His court-appointed attorney, the one entrusted to safeguard his rights,  ensure a fair trial, and prove his innocence, engaged in an inappropriate sexual act with Shayne's own mother during his case, in his office while scheduled to bring information pertaining to his case. Our revelation, however, does not change the fact the information can paint his mother in a negative light, as well as affecting the perception of some regarding his innocence. This unimaginable betrayal further shattered Shayne's faith in the system, leaving him feeling abandoned and unheard.

We mercifully ask you to consider his innocence. The agony and suffering: the weight of a wrongful accusation, the disbelief and confusion and lengthy prison sentence. Was his view ever really considered? Would you feel as if yours was? Mr. Guest was convicted on a single testimony. He had an alibi. Shayne Guest has been through a significant amount of experiences dealing with his case.

 Additional to his accusation, his representation had a sexual exchange with Mr. Guest's mother in his office during his process. Guest mother is ashamed of this sexual exchange. Nomatter how you look at it, it's wrong on his behalf. She said the attorney offered a favor, however he denied that he offered a favor but admitted to the Virginia State Bar that the exchange took place. This was dismissed by The Virginia State Bar because the attorney said this act did not affect his representation.

First and foremost, this sexual act creates a conflict of interest between the attorney and client. The attorney is supposed to act in his client’s best interest, but in this case, he has engaged in conduct that could compromise his ability to do so. Even if he did not offer a favor from the prosecutor in exchange for the sexual act, the fact that he engaged in this conduct with Mr. Guest's mother creates the appearance of impropriety and could lead to questions about whether he was truly acting in Guest best interest during his trial. Even if he believes that the sexual act did not affect his representation, the fact remains that it could have and that presents a serious problem. To have such behavior take place raises many questions. And to have it happen during the course of such a serious process, should not be allowed to stand.

In his darkest moments, Shayne clung to his innocence and refused to let bitterness consume him. He sought knowledge, education, and self-reflection behind bars, determined to emerge stronger and more compassionate. He is a co-founder of an app, he helps facilitate a Life Recovery Group, he is a teacher's aide helping those get GEDs. He has created a platform for change.

Today, as we collectively strive for justice, we rally behind Shayne Guest and demand a thorough reevaluation of his case. The emergence of new evidence, demands our attention and scrutiny. It is time to acknowledge this miscarriage of justice that has befallen him and countless others.

Shayne's story serves as a stark reminder of the flaws within our justice system. It calls upon us to question the validity of single testimonies as the sole basis for conviction, to demand that alibis be given the attention they deserve, and to recognize the importance of every individual's voice, regardless of their circumstances.

Guest has emerged from the darkness, stronger and more determined than ever. Let us stand beside him, offering our support, compassion, and unwavering belief in his innocence. Together, we can rewrite the narrative of his life, transforming it into a story of resilience, redemption, and ultimately, justice.
