The Issue
Antony Blinken, the current US Secretary of State, stands accused of violating US law to offer support to Israel's genocide and crimes against humanity. US laws stipulate that aid should only be given to countries respecting human rights and principles of sovereignty. Disregarding such principles jeopardizes our commitment to international law and paves the way for grave violations of human rights. We need justice and transparency in our governance, especially from those in key positions such as the Secretary of State. This is why we demand the US Department of Justice investigate and indict Antony Blinken for lying to the American people, lying to Congress, and violating US and international law. A printed copy of the indictment will be delivered to the US Department of Justice in Washington DC on Friday, 10 January 2025.

INDICTMENT
The People’s Grand Jury charges that, at all times material to this Indictment, on or about the dates and at the approximate times stated below:
INTRODUCTION
1. The Defendant, ANTONY J. BLINKEN, is the seventy-first Secretary of State of the United States of America. As Secretary of State, he is the President’s chief foreign policy advisor and carries out the President’s foreign policy through the Department of State. He also is the principal congressional relations officer of the State Department and accountable to Congress via certifications and reports related to U.S. foreign policy as specified in relevant statutes. One such statute is Foreign Assistance Act of 1961, the portion of which codified at 22 U.S.C. 2378d is known as the “Leahy Law.” The Leahy Law prohibits the U.S. Government from using funds for assistance to units of foreign security forces where there is credible information implicating that unit in the commission of gross violations of human rights (“GVHR”). Another such statute is the Arms Export Controls Act, the portion of which codified at 22 U.S.C. § 2778(a)(2) requires that decisions on issuing export licenses shall take into account whether the export of an article would increase the possibility of outbreak or escalation of conflict.
2. Moreover, as Secretary of State, the prime Cabinet officer, and a leading member of the National Security Council, the Defendant is obligated to ensure that the international treaties signed by the United States, ratified by Congress, and codified into statutes are faithfully executed and enforced. Those treaties include the four Geneva Conventions of 1949, codified into U.S. law by the War Crimes Act, 18 U.S.C. § 2441, and the Convention on the Prevention and Punishment of the Crime of Genocide, codified into U.S. law by the Genocide Prevention Act, 18 U.S.C. § 1091. As a responsible U.S. Government official, he also is bound by the Principles of International Law Recognized in the Charter of the Nüremberg Tribunal and in the Judgment of the Tribunal, 1950 (“Nüremberg Principles”).
3. Since Israel’s latest invasion of Gaza in October 2023, the Israel Defense Forces (“IDF”) have continually committed Genocide against the Palestinian people living there as defined by the Convention on the Prevention and Punishment of the Crime of Genocide and the Genocide Prevention Act. The IDF’s acts include summary executions and intentional mass killings of noncombatant Palestinians, disproportionate attacks by the IDF that, conservatively estimated, have killed upwards of forty-five thousand people, utter destruction of cities, hospitals and health services, mosques, schools, universities, and other cultural, historical and governmental properties, ethnic cleansing, intentional starvation of civilians and deprivations of water and energy supplies. Omer Bartov, one of the world’s leading experts on genocide and Professor of Holocaust and Genocide Studies at Brown University, describes Israel’s Genocide as,
[A] systematic attempt to make Gaza uninhabitable, as well as to destroy all institutions that make it possible for a group to sustain itself, not only physically but also culturally, its identity, its collective memory, which meant a systematic destruction of universities, of schools, of mosques, of museums and, of course, of housing and infrastructure. So, what you could see by then was . . . that the population, having been displaced many times and, as you heard before, vast numbers of them being killed, wounded and debilitated, would never be able to reconstitute itself as a group in that area.
4. During the last fifteen months with respect to the IDF’s conduct in Gaza, as described herein, the Defendant knowingly made false statements to Congress with respect to his obligations under the statutes and treaties described in paragraphs 1-2 above. These false statements and his repeated, deliberate failure to enforce the statutes and treaties have allowed the IDF to continue committing GVHRs and conduct an unabated and unhindered campaign of Genocide against the Palestinian people in Gaza with diplomatic support and weapons supplied by the United States. The Defendant is, thus, complicit in Genocide and other War Crimes in violation of the Genocide Prevention Act and the War Crimes Act. Further, his false statements and complicity in Genocide and War Crimes constitute a deprivation of the right honest services to which the People of the United States are entitled.
