Impose Legislation to Prevent Insurance Companies from Unjustly Denying Claims
The Issue
I suffered firsthand from the ruthlessness of insurance companies. A substantial depreciation claim was denied by a well-recognized insurance company. Despite no fault on my part, an accident left me with a car that had substantially decreased in value.
Unfortunately, my case is not unique. It is my understanding that other insured individuals face similar manipulative practices of delay or denial from insurance firms each year. Beyond the evident lack of transparency, individuals struggle to even identify the underwriter responsible for their claim when needed. We are in the era of computers and dashboards. Why are insurance companies not using these artifacts?
The alarming consequences of this issue have garnered public attention recently. The overwhelming support garnered for the killer of the United Healthcare CEO underscores the widespread discontent regarding the health insurance industry's practices. The current regulations fail to sufficiently protect victims of such practices (i.e. the consumers). Only 14 states have imposed regulations to discourage 'bad faith' insurance practices as of 2019 ("The State of Insurance Bad Faith Law," 2019, Cornell Law Review). More enforcement is needed at national level.
The objective of this petition is to urge lawmakers to draft and enforce legislation that curbs such abusive practices by insurance companies of all types and sizes. Ensure that insurance companies honor legitimate claims, observe transparency, and that stiffer penalties exist for those who do not adhere to these stipulations.
