Impose a time limit on lower judiciary case decisions
The Issue
Fifteen years ago, I embarked on a journey to secure a home, an aspiration shared by countless individuals across India. A promise that was tangible, personal, and deeply cherished. However, this promise soon turned into a prolonged nightmare of endless legal battles. Despite diligently approaching every conceivable mode of justice – from the Real Estate Regulatory Authority (RERA), National Consumer Disputes Redressal Commission (NCDRC), Economic Offences Wing (EOW), to the National Company Law Tribunal (NCLT) – all yielded the same disheartening result: repeated postponements and endless dates.
This isn't merely an isolated case; it's a pervasive issue spanning the entire nation. Each delay represents not just time lost but a heartbreak, a family stranded in hope; some have tragically not survived to see the resolution of their rightful claims.
The core of this crisis stems from one critical deficiency – the inordinate delays in decisions by the lower judiciary. These delays have become a routine hurdle in the justice system, eroding trust and denying citizens the justice they so desperately seek. Cases drag on, often unnecessarily, for years before they even reach higher courts or the Supreme Court, leading to a cycle of frustration and despair.
It's high time for a change. We propose implementing a reasonable time limit for the lower judiciary to decide on cases. This would not only expedite the judicial process but also ensure that justice is not but a distant dream for those engaged in legal disputes. Moreover, when a case is escalated to superior courts, these courts should be empowered to question and hold the lower judiciary accountable for any unreasonable delays involved.
According to the National Judicial Data Grid, millions of cases are pending in the Indian courts, with a significant percentage lingering beyond five years. Such figures highlight the urgent need for reform.
By signing this petition, you are lending your voice to a cause that demands accountability, efficiency, and, importantly, justice within a reasonable timeframe. Together, we can foster a judicial system that is fair, swift, and responsive to the needs of our people, ensuring that no one has to suffer the cruel limbo of indefinite legal wait times. Please, join in this call for reform and sign the petition now.
