I am addressing this petition out of personal anguish and a broader concern for public safety. My father, who was sentenced to 72 years in Indiana Department of Corrections in 1994, sexually abused me and my two older sisters. Both of them are no longer with us. Due to "good behavior" regulations, he received time reductions and as of March 4th, 2025, he has been discharged on supervised parole for two years. Because his abhorrent acts were committed in 1992, he has escaped the requirement to register as a sex offender, as the registry law did not come into effect until 1994.

The heart of the matter is this: due to a technicality based on timing, individuals who committed sexual offenses before 1994 in Indiana are free from the legal mandate to register as sex offenders. This loophole in the system is not just allowing my father but potentially others who have caused profound harm, to evade full retribution for their actions and possibly pose an ongoing threat to society. 

Every year, approximately 433,648 victims in the U.S suffer sexual assault, according to the Rape, Abuse & Incest National Network (RAINN). A significantly large number of sexual offenders evade justice, and by not updating this law, we only reinforce their impunity. Moreover, the U.S Bureau of Justice states that the rate of recidivism among sexual offenders stands at an alarming 5.6%.

This is an appeal to Governor Mike Braun, The Indiana House of Representatives, and the Indiana Senate to consider retrofitting the Sex Offender Registry and INSOMM requirements, enforcing them on individuals who committed their crimes before these laws came into effect. With this change, we seek to tighten the net on those evading rightful penalties and increase the security of our community. Stand with us for justice and community safety. Me dirijo a esta petición por angustia personal y una preocupación más amplia por la seguridad pública. Mi padre, que fue condenado a 72 años en el Departamento de Correcciones de Indiana en 1994, abusó sexualmente de mí y de mis dos hermanas mayores. Ambos ya no están con nosotros. Debido a las regulaciones de "buen comportamiento", recibió reducciones de tiempo y, a partir del 4 de marzo de 2025, ha sido dado de baja bajo libertad condicional supervisada durante dos años. Debido a que sus actos abominables se cometieron en 1992, ha escapado del requisito de registrarse como delincuente sexual, ya que la ley de registro no entró en vigor hasta 1994.

El meodo del asunto es este: debido a una tecnicidad basada en el tiempo, las personas que cometieron delitos sexuales antes de 1994 en Indiana están libres del mandato legal para registrarse como delincuentes sexuales. Esta laguna en el sistema no solo permite que mi padre, sino potencialmente otros que han causado un daño profundo, evadan la retribución total por sus acciones y posiblemente representen una amenaza continua para la sociedad.

Cada año, aproximadamente 433.648 víctimas en los Estados Unidos sufren agresión sexual, según la Red Nacional de Violación, Abuso e Incesto (RAINN). Un número significativamente grande de delincuentes sexuales evade la justicia, y al no actualizar esta ley, solo reforzamos su impunidad. Además, la Oficina de Justicia de los Estados Unidos afirma que la tasa de reincidencia entre los delincuentes sexuales es alarmante del 5,6 %.

Este es un llamamiento al gobernador Mike Braun, a la Cámara de Representantes de Indiana y al Senado de Indiana para que consideren actualizar el Registro de Delincuentes Sexuales y los requisitos de INSOMM, haciéndolos cumplir a las personas que cometieron sus delitos antes de que estas leyes entraran en vigor.
