Judge System
Speed Of Decisions
Most cases go to only one person. A judge gives judgment in approximately 5,000 to 20,000 cases during his tenure. Due to this the cases remain pending for years.
Continuity Of Alliance
Usually a judge stays in a court for 3-4 years. Due to sufficient time, it becomes easy for criminals and lawyers to form an alliance with the judge. And this alliance continues. In many courts, judges also maintain alliances among themselves and give decisions in favor of each other's relatives. This is called Cross-Nepotism.
Protection From Organized Crime
If 1000 cases are registered against a gang and its leader in 4-5 years, then in the judge system all these cases will go to 5-10 judges. So in the judge system, to intimidate the witnesses, influence the investigation and get released, the mafia leader only has to form an alliance with 5-10 judges, so that the judge slows down the pace of hearing of his cases.
Possibility Of Coming Under Pressure
The role of senior judges is decisive in the promotion, transfer, removal etc. of junior judges. Therefore, in most of the cases, influential accused succeed in influencing the junior judges.
Opportunity To Take Bribe
It is an open matter that a certain judge has given the decision. Because of this, if a judge takes bribe, he has to give the verdict according to the person taking the bribe. Otherwise, the mediating lawyer will not come forward with a bribe offer for him. Apart from this, when pressure comes, they have to change their decisions even if they do not want to.
Jury Court
Speed Of Decisions
Because there is a separate jury for each case, the verdict comes within a week or two. A person who has given a verdict in a case is not called to the jury for the next 5 years.
Continuity Of Alliance
Jurors are temporary and come to the jury only for a week or two. It is difficult for any lawyer to silently form an alliance with any 8 of these 12 members. This work becomes even more difficult and risky when the lawyer has to do this work in just a week.
Protection From Organized Crime
Each case will go to a separate jury of 12-15 citizens, and 15*1000 = 15,000 jurors will be selected by lottery. Juries hold hearings regularly from 11 a.m. to 4 P.M. Next date in Juri means next day!! And in this short period of time the kingpin will have to form alliances with approximately 12,000 jurors. Which is also a mathematically impossible task.
Possibility Of Coming Under Pressure
The citizens who appear on the jury are not in anyone's employ. They come to the jury only to hear a case for some time and give a verdict. Therefore, pressure from any officer etc. does not work on them.
Opportunity To Take Bribe
In the jury system each juror gives his/her verdict in the form of Yes/No in a sealed envelope. So even if the accused influences any 5 out of 15 jury members by pressure/incitement in some way or the other, they can give a verdict against him. Because it can never be ascertained which juror has given what verdict.
