Our fight for HAND-MARKED PAPER BALLOTS didn't end in November and we've updated our petition for to prove it!  Let's keep the voice of Georgia Voters loud and clear.  Help us show the courts and nation that the people of Georgia overwhelmingly support an immediate switch to hand-marked paper ballots by SIGNING, SHARING, and RECIRCULATING our petition!  We are already so close to 5,000 signers strong and with your help we will make an enormous impact on the decisions soon to be made in the 2019 legislative session.

- A federal appeals court on Thursday upheld a judge’s ruling that said Georgia’s electronic voting system poses a “concrete risk” to secure elections. The case now RETURNS to Judge Totenberg’s court, where the attorney representing the Georgia Voters who filed suit, said he will seek to move quickly toward a trial.

The decision from the 11th U.S. Circuit Court of Appeals allows the voting system lawsuit to move forward. The plaintiffs, who are election integrity advocates and concerned voters, want U.S. District Judge Amy Totenberg to switch Georgia’s statewide voting system to hand-marked paper ballots. Totenberg ruled in September that the plaintiffs will likely succeed in the lawsuit, but she denied their request to immediately switch to paper ballots so close to November’s midterm elections.“Now we can get past the defendants’ delays and move forward with the case on the merits and get the relief Judge Totenberg already ruled we’re entitled to,” said David Cross, an attorney for Georgia voters who sued. “This appeal was meritless from the start.”

The appeals court ruling rejected assertions that the state election officials have immunity. The court also found that it didn’t have jurisdiction at this point in the case to address claims that the plaintiffs lack standing to sue.

"While Plaintiffs’ motions for preliminary injunction are DENIED, the Court advises the Defendants that further delay is not tolerable in their confronting and tackling the challenges before the State’s election balloting system. The State’s posture in this litigation - and some of the testimony and evidence presented - indicated that the Defendants and State election officials had buried their heads in the sand. This is particularly so in their dealing with the ramifications of the major data breach and vulnerability at the Center for Election Services, which contracted with the Secretary of State’s Office, as well as the erasure of the Center’s server database and a host of serious security vulnerabilities permitted by their outdated software and system operations."
