Special meeting regarding Blue Stream contract.

The Issue

Petition to Board of Directors for a Special Meeting. At least 137 (one hundred thirty seven) signatures required by homeowners.

Whereas on this day, July 29, 2020, we the undersigned as the homeowners of the Imperial Wilderness Condo Association at 14,100 Tamiami Trail East, Naples, Florida, 34114 petition a request for a special meeting of the Board of Directors at such time as a quorum of the members can be assembled, to address the following and any other homeowner questions regarding the Blue Stream contract for cable television.


1. Why are we allowing nonessential contractors into the park?

2. Why did we sign a contract for 2021 when the budget is not yet approved?

3. Did Xfinity have the opportunity to counter Blue Stream’s second offer?

4. Why did we lock into a contract for 10 years for a nearly obsolete way of watching television?

5. Since Docusign is now legal in the US for contracts, why were the homeowners not given the opportunity to examine both the Xfinity and the Blue Stream bids?

6. Why did we give into the threat of a high pressure sales pitch to sign within 30 days?

7. Why was this contract signed by Tim Johns in place of two members of the Board of Directors?

8. For how many months can we vacation suspend and at what cost per month as well as what cost to restore service when we return to the park?

9. What is the average cost per homeowner to do inside wiring in the walls?

10. Why does it only cost the general public $18.95 for Digital plus with Blue Stream when the contract quotes $19.95 and the handout says $20.95?

11. What is the difference between digital core and digital plus?

12. What is the $109,200 payment to the Association for and who gets it?

13. The contract says “if” this contract is ratified. Who ratifies it and when does that happen?

14. Where is attachment A and where are pages 15, 16 and 17?

15. After looking at residents bills, we find we pay $33 via HOA fee for Xfinity. Why is $36 per month for Bluestream a better deal?

16. Why are we allowing baseboard wiring which might create a trip and fall hazard for our seniors?

17. How will I be able to access my Amazon prime or Hulu on Blue Stream when I don’t see it on the menu?

18. I see that Blue Stream works with Netflix. What about Roku, fire stick, YouTube TV, Fubo, Filo, Sling, AT&T TV now, Pluto, Zumo, etc.?

19. In paragraph 1 a of the contract, why is Blue Stream removing our coax?

20. What if our only exterior 120 V AC outlet is on the front of the house? Will the ONT box be mounted there?

21. In paragraph 2b of the proposed contract, why are RV sights getting coax in place of fiber?

22. If blue stream goes under, do we have any control over who they sell us off to?

23. Did we hire a telecommunications consultant and if so, how and when is their commission paid?

24. Is a TiVo box wireless or does it need to be connected directly to fiber?

25. If our homes are not currently equipped with RG-6 coaxial cable, do we have to pay to upgrade?

26. Will the fiber being placed by Blue Stream in the street work with our current coax cable from Xfinity and will it choke the speed of transmission?

27. How will trenching affect fully paved lots or those covered with pavers and who pays to replace it to its original condition?

28. After Dig safe has confirmed the location of our water, sewer, electric, cable, phone, sprinkler lines, etc., who pays for any damages that might be incurred if Blue Stream, in the process of installation, causes any damage?

29. How many companies were queried for quotes for our cable TV service?

30. How many other methods of watching TV by streaming were investigated before deciding on Blue Stream?

31. Is Blue Stream going to open a local office in or near Naples to replace things like TiVo boxes etc.? It seems that Coral Spring, FL is the closest office.

32. If our TiVo box fails, who pays to replace it over the 10 year term?

33. What percent increase per year is on our current contract with Xfinity?

34. For those of us who don’t do electronics or bill paying online, why are we paying $3.49 for each bill per month?

35. Will there be someone on site for our older homeowners to help us learn the new remote control and the new TiVo box?

36. How will the HOA fee be adjusted for those who vacation suspend their television service at $8.00 per month in place of $36.00 for the regular monthly billing?

37. Why didn’t we negotiate for three cable boxes with Blue Stream as we currently have with Xfinity?

38. Were the homeowners ever surveyed for their television viewing preferences.

39. Why did the BOD not just walk away and defer to the master deed, paragraph 10.1 which states, “If the Asociation contracts for cable or master antenna television programming services in bulk for imperial wilderness, the cost of such services shall be a common expense.” found in section 10, assessments and liens.
