Re-Open Temporary Public Policy For Vietnamese Without Status in Thailand
The Issue
On December 17, 2011, the Minister of Citizenship and Immigration Canada (CIC) created a special humanitarian refugee program, “Temporary Public Policy”. This policy deals with certain Vietnamese persons residing in Thailand without status, under section 25.2 of the Immigration Refugee and Protection Act (IRPA).
On December 19, 2012, CIC worked with the Vietnamese Canadian Federation (VCF) to implement the Temporary Public Policy, allowing 33 Vietnamese families to settle in Canada. They needed to meet the following conditions:
- Being a Vietnamese who left Vietnam during the period of 1984 to 1991
- Being stranded in Thailand
- Having no legal status in any country
- Having no refugee status as recognized by the United Nations High Commissioner for Refugees (UNHCR)
VCF handed over the signed paper work to the Vietnamese Overseas Initiative for Conscience Empowerment (VOICE) and VOICE Canada, which are 2 non-profit organizations incorporated in the US and Canada. VOICE (US) and VOICE Canada were to compile the list of eligible cases, and to take care of the resettlement process.
In 2018, VOICE and VOICE Canada reported to the Canadian government that the program was completed and closed in 2018.
Boat People SOS (BPSOS) is a non-profit organization founded in 1981 with 17 offices in the US and 2 offices in Southeast Asia, serving refugees in Thailand and Southeast Asia.
Since May of 2023, BPSOS has exposed immigration fraud as well as a group of 13-18 people with fake profiles who were settled in Canada without any eligible status by taking advantage of the humanitarian program as led by VOICE Canada.
BPSOS has also confirmed:
- There is an organized operation that has sent many ineligible people to settle in Canada
- The ineligible people had to pay large sums of money in order to come to Canada, making an unjust system to less fortunate individuals
- These ineligible people were trained to deceive the immigration officers in Canada
- The organization has been using the media to spread false information about the ineligible people’s identities
- The organization uses slander, hate, threats, and bribes to silence witnesses and those who question the selection process and financial donation spendings
The number of people who were illegally sent to Canada matches the number of people who were eligible. In the meantime, around 35 to 70 eligible people are still stuck in Thailand.
The fates of the people still stranded in Thailand are tragic. They can’t return to Vietnam and no other country would accept them for asylum. They are forever stuck in Thailand without any legal status, without any way to get a job, and with the possibility of going to jail.
For the sake of these innocent families, we plead to the Canadian government to:
- Reopen the only humanitarian program - the Temporary Public Policy - that can help resettle all the identified victims who are still stranded in Thailand
- Investigate the immigration fraud from organization(s) and bring justice to the individuals involved in the crime

VCF giao lại cho VOICE - một tổ chức phi lợi nhuận ở Mỹ và chi nhánh VOICE Canada có nhiệm vụ lập hồ sơ, tổng hợp danh sách, thiết lập những hồ sơ xin định cư ở Canada.
Năm 2018, VOICE và VOICE Canada báo cáo với chính phủ Canada là chương trình đã hoàn tất và đóng lại năm 2018.
Thuyền Nhân SOS (BPSOS) là một tổ chức phi lợi nhuận thành lập năm 1981 ở Mỹ vớI 17 văn phòng chi nhánh ở Mỹ và 2 văn phòng chi nhánh ở Đông Nam Á, phục vụ những người tị nạn ở Thái Lan và vùng Đông Nam Á
Tháng 5, 2023 vừa qua, BPSOS đã phanh phui và có đầy đủ chứng cớ cũng như nhân chứng có từ 13 -18 hồ sơ giả đã được định cư tại Canada mà hoàn toàn không đủ quy chế hợp lệ qua chương trình nhân đạo do VOICE Canada đảm nhận. Ngoài ra BPSOS đã xác nhận:
- Có một đường dây hoạt động có tổ chức đã đưa nhiều người không hợp lệ đi định cư
- Những người không hợp lệ đã phải trã rất nhiều tiền cho tổ chức để được định cư ở Canada,
- Để qua mặt nhân viên đi trú Canada, những người đi bất hợp lệ đã được tổ chức hướng dẫn khai gian,
- Dùng phương tiện truyền thông để đưa tin giả về lai lịch của những người này,
- Vu khống, chụp mũ, đe dọa, mua chuộc nhằm bịt miệng nhân chứng và những ai đặt nghi vấn.
Số người qua Canada không hợp lệ ăn khớp với số người hợp lệ mà còn kẹt lại Thái Lan: khoảng 35 đến 70 người.
Số phận của họ rất đau lòng, bi đát: về Việt Nam không được, đi tị nạn cũng không ai nhận, không tổ quốc, không tiếng nói, không một lối thoát, và bị kẹt vĩnh viễn tại Thái Lan.
Chỉ còn một chương trình nhân đạo duy nhất này để xin cho những người còn kẹt lại ở Thái Lan được định cư theo đúng thủ tục.
Chúng tôi, những người dân đang sống tại và ngoài Canada, thỉnh cầu chính phủ Canada vì sự nhân đạo và công bằng:
- Mở lại chương trình nhân đạo định cư cho những nạn nhân còn đang mắc kẹt ở Thái Lan
- Điều tra và truy tố những ai đã phạm pháp trong đường giây đưa người bất hợp lệ vào Canada.

Le 17 décembre 2011, le Ministre de la Citoyenneté et de l'Immigration du Canada (CIC) a créé un programme humanitaire spécial pour les réfugiés, soit "la politique publique temporaire". Cette politique a été taillée sur mesure pour certains Vietnamiens qui résidaient en Thailande sans aucun statut selon la section 25.2 de la Loi sur l'immigration et la protection des réfugiés (LIPR).
Le 10 décembre 2012, le ministère de la Citoyenneté et de l'Immigration du Canada (CIC) a confié à la Fédération canadienne des associations vietnamiennes (FCAV) le mandat d'implantation de cette politique publique, permettant à 33 familles vietnamiennes à se rétablir au Canada. Ces personnes ont à remplir les conditions suivantes:
o Être des Vietnamiens qui ont quitté le Vietnam pendant la période entre 1984 et 1991
o Être pris à vivre sans aucun statut légal en Thailande
o N'ayant aucun statut légal dans aucun pays
o N'ayant pas le statut de réfugié reconnu par le Haut Commissariat des Nations Unies pour les réfugiés (UNHCR)
La Fédération canadienne des associations vietnamiennes (FCAV) a alors confié l'engagement légal à l'organisation intitulée VOICE (the Vietnamese Overseas Initiative for Conscience Empowerment), incorporée aux États-Unis, ainsi qu'à VOICE Canada (une affiliation candienne de cette dernière). Ce sont ces deux organismes américain et canadien qui ont procédé à la constitution de la liste d'éligibilité ainsi qu'à l'exécution du processus de relocalisation au Canada.
En 2018, VOICE et VOICE Canada ont rapporté au gouvernement du Canada que le tout a été complété et que ce programme a donc été fermé.
Or, depuis le mois de mai 2023, le Boat People SOS (BPSOS), un organisme à but non lucratif fondé en 1981 aux États-Unis a dévoilé une fraude en matière de l'immigration concernant la relocalisation au Canada d'un groupe de 13 à 18 personnes sous de fausses identités. Avec ses 17 points de service aux États-Unis ainsi que 2 autres bureaux établis en Asie du Sud-Est au service des réfugiés en Thailande et en Asie du Sud-Est, le Boat People SOS (BPSOS) a indépendemmant mené une enquête sur l'état de non éligibilité de ces personnes ayant profité des avantages de ce programme ainsi mené par VOICE Canada.
Le BPSOS confirme donc:
o Qu'une opération organisée a eu lieu pour établir au Canada des personnes non éligibles selon les termes du programme ci-haut mentionné
o Ces personnes non éligibles ont eu à payer d'importantes sommes d'argent afin de s'établir au Canada par cette voie. C'est une injustice incommensurable vis à vis ceux qui ont été laissés pour compte aujourd'hui.
o Ces personnes non éligibles ont été dotées des moyens pour frauder les officiers de l'Immigration du Canada
o Ces organismes organisateurs de la relocalisation ont utilisé les médias pour propager les fausses informations sur l'identité de ces personnes non éligibles
o Ceux qui questionnent leur processus de sélection et l'utilisation des dons reçus ont reçu des propos diffamatoires et haineux, des menaces tout comme des pots-de-vin.
Il est à noter que le nombre de personnes qui ont été illégalement reçues au Canada concorde avec celui de ceux qui ont été laissés pour compte: environ de 35 à 70 personnes qui sont encore pris à vivre sans aucun statut légal en Thailande aujourd'hui étaient des personnes éligibles à ce programme spécial mentionné plus haut.
Le sort des victimes de cette fraude est tragique. Ces pesonnes qui vivent toujours sans aucun statut légal en Thailande ne peuvent retourner vivre au Viet Nam. Ces gens ne peuvent trouver asile dans aucun autre pays dans le monde. Ils seront pris à vivre comme des fantômes en Thailande, sans aucun moyen de bien gagner leur vie, et se trouvent toujours dans la menace de se faire jeter en prison.
Au nom de ces familles innocentes, nous implorons le gouvernement canadien à:
o réouvrir cet unique programme humanitaire concernant la Politique publique temporaire, permettant la relocalisation des victimes ainsi identifiées et qui se trouvent toujours en Thailande
o d'ouvrir une enquête sur cette fraude organisationelle en matière de l'immigration
