
Today, after MANY years (essentially a decade) of hard work, we have finally been able to get what we have sought all along - a Notice to Appear (NTA), placing Javier in removal proceedings, where he has an extremely compelling case for cancellation of removal for non-residents. This has effectively ended all the challenges & obstacles we had been facing for many years (too long & complicated to detail here), and given Javier & his family FINALLY the chance to go in front of an Immigration Judge in Miami & present his exceptional case.
AND THIS IS THANKS TO ALL THE AMAZING SUPPORT & EFFORTS OF YOU!
On behalf of Javier & his family - and with a huge shout-out to the hard work of my colleague Rebeca Sanchez-Roig, Esq., we are extremely appreciative & ecstatic at this amazing moment & achievement. We thank God for His motivation & blessings, pushing us all forward in this long & difficult process. More than once, I fell down on my knees & prayed as I waited for Javier at the DHS / ICE office in Miramar, not knowing if he was being put on a van to Krome or to an airport for his deportation. I questioned my own faith many times in this process, wondering what sense it could make to send him to Mexico & away from his family. We thank DHS / ICE for exercising its inherent prosecutorial discretion in this truly deserving & compelling case.
I can’t say enough how much I respect & appreciate Javier & his family for putting his faith & trust in us all these many years. He’s told me more than once that ALL he wants to do is finish his job of raising his family here in the USA. It’s our hope we can accomplish this - and even more.
Thank you to all who signed the petition, especially in last several days. But also a BIG thx to all who contacted me along the way, & lending support in numerous ways. It often felt like David vs the Goliath in many ways. Thank you to my team as well - Ceci, Karla, & Aimer in my office- and the many others who have worked this case w us along the way. I write this update w tears in my eyes, knowing full well that what we do as a team is not only important work, it’s been my absolute privilege to work w such a great team & with great clients like Javier.
Javier’s first hearing (believe it or not) appears to be in May of 2024, but we hope to at least try to move this up so I still have some hair left on my head by the end of this case! Thanks again to everyone for supporting this petition & to www.change.org for giving us this amazing & invaluable platform to help Javier in this case.
