Idaho Families Demand Reform: Fix the Family Court System
The Issue
Across our state, thousands of parents are experiencing a family court system that too often prioritizes procedure over the wellbeing of children. While the vast majority of judges and attorneys work with integrity, there are systemic gaps in the law that allow harmful outcomes to occur with little accountability.
Parents across Idaho have shared stories of delayed hearings, ignored evidence, financial devastation, and children being separated from loving parents for months or years while cases slowly move through the system. When accountability mechanisms fail, children pay the price.
Over the past year, legislators, legal experts, parents, and advocates traveled the state and met extensively to study these issues through the Child Custody Task Force. The result was a set of carefully researched legislative reforms designed to restore balance, transparency, and fairness in family court proceedings.
Unfortunately, a small group of legal professionals who line their pockets off the travesties of our children’s childhoods have begun opposing these reforms — reforms that were created specifically to protect children and ensure that courts remain focused on the best interests of families.
These reforms are not radical. They simply aim to ensure that:
• Children maintain meaningful relationships with both parents whenever safe and possible.
• Courts apply clear and consistent standards when making custody decisions.
• Evidence used in court can be challenged and verified.
• Families are not financially destroyed by prolonged litigation.
• Parents have access to fair procedures and due process.
• Accountability exists when court processes fail children.
Family courts should not be a place where families feel powerless or where children become collateral damage in a legal process that lacks transparency.
The goal of these reforms is simple:
Protect children. Strengthen families. Restore trust in the courts.
