There must be a better solution to Australia's broken compensation system. But it will take a groundswell of public opinion to achieve change.
The time is now to raise our voices.
Currently, if you suffer a head injury due to negligence on the roads or in the workplace, you have a decent chance of being acknowledged and compensated. But, if you suffer a head injury due to negligence in hospital, you are significantly less likely to receive compensation or any acknowledgement. This is both unfair and cruel.
A major barrier to receiving compensation is the reluctance of doctors to testify against other doctors. The consequences of losing a claim are not only financial: it can mean medical records that continue to obscure the cause of injury for years afterwards.
Injured patients or their surviving family members should not have to rely on the current adversarial process as the only option for accessing compensation. Medical negligence litigation is only open to a fraction of people injured in the healthcare system. It can amplify animosity between the parties and is lengthy and distressing, both for injured patients and for defendant doctors.
That is why we need as many signatures as possible.
