

A child accused of first-degree murder from the beginning without a proper investigation,
Derek Rosa has been held isolated for more than a year now in a Detention Center for
adults called Metrowest in Miami, Florida. The irregularities in his case are extremely
evident, they have awakened an outrage in the international and national community
which has advocated justice and transparency in the case.
Our only wish is that No child should ever have to go through what Derek Rosa has gone
through this long year. No child should ever deserve to have their constitutional rights
violated in the way that happened in Derek Rosa’s case. We ask Florida laws to be changed
in cases involving children to be investigated thoroughly.
Self-incriminating at the age of 13 years old is not enough evidence to send a child to
detention in solitary, and even more when protocols as important as the Baker Act were
violated, the first violation to the Derek Rosa’s case, among many others are:
- Educational rights and a 504 plan implementation.
- Rights to health care; a child who has autism and attention deficit disorder.
- Violation to the 4th amendment; this child has suffered violations to his privacy by
being exposed to the public (news and social media) as guilty in an open case.
- Violation of the 5th amendment; right to not self-incriminate
- Violation of the 6th amendment; Derek was interviewed as form of interrogation at 3:00
am without an adult or lawyer present, and also was sleep deprived.
- Violation of the 8th amendment; cruel and unusual punishment (held isolated for more
than 20 hours a day)
I plead to you to help clarifying this case, no child deserves to spend their days in jail for
a wrong investigation process. This is a wonderful country where God’s justice prevails.
Derek Rosa does not deserve to pay for a crime he did not commit. Please bring back our
faith in the justice system of this great nation.
