The CJI should know that there are repeated and repeated cases in Supreme Courts and various other Courts on the issue which have been laid to rest by Constitutional Bench of Supreme Court.M Nagraj & Ors (2006) is one of those judgments in which the issue of reservation in promotion was decided and the Hon’ble Court ordered that against the reservation in promotion. Instead of transgressing in the executive functions of the State the CJI should ensure that there is compliance of the Supreme Court Judgments not only by the High Courts and CAT but also by the Departments of Central and State against and regarding whom the Judgments are passed.
