At the outset, we EXPRESS OUR SINCERE THANKS & GRATITUDE TO 6025 PEOPLE out of lakhs of Retirees who have over whelmingly extended support to our on going struggle initiated in the interest of all Bank Retirees and the pace of support is still on seeking redressal of the following Bank Retirees/ pensioners issues:
(1) Periodical updation of pension,
(2) 100% DA Nuetralisation,
(3) Improvement in Family pension,
(4) 2nd Pension Option to left over VRS, CRS & Dismissed Bank employees at par with Retirees of Central Government under CCS Rules, 1972.
The original petition to our Hon'ble PM / FM pleading for approval of above issues in favour of helpless, aged Bank Retirees was initiated by TEAM: Jayaprakash, Jayaraman, Jayaram, HSN Murthy, HS Vasudeva Rao & Vijayalakshmi was submitted on 12.12.2016 followed by repeated reminders citing many Court orders in similar cases on 06.04.2017 justifying rightful & lawful entitlement on http://pgportal.gov.in. But the same has been neither responded & nor redressed except a stray case which was referred to IBA which as usual disposed of the same as sub judice without citing any particular case of reference.
Suddenly to our surprise, today Somebody has floated news line purported to have quoted from Business Lines journal that IBA/Gov. has now agreed to consider the Retirees grievances. Please beware, this news was very old & circulated during April 2015 prior to signing of X BPS by the UFBU in collusion with IBA excluding the issues of Retirees, thus the Bank Retirees have been once again cheated as has been done during last two decades. Hence, the so called news is fake & fictitious aims to create confusion & diversion in the matter.
Pension updation etc., is allowed to Govt employees under CCS Rules, 1972 just because their nearness to decision making buracracy for which we are not jealous, but why the same benefits are denied & deprived to Bank & LIC Retirees when Rules & Regulations are same.
Atleast, LIC Retired Officers Association has filed WP No 4894 of 2016 before the High Court of Delhi against LIC of India for Pension updation. The Hon'ble Justice was very critical & expressed his anguish on the approach of LIC management about its bad treatment of it's own ex-employees and asked the concerned parties to file arguments, written submissions on 21.02.2017.
The LIC Retired Officers Association has reportedly filed an exhaustive reply to the Hon'ble Court pointing out the deliberate, prejuducial, descrmination meted out to them. Their meaning & interpretation of LIC Pension Regulations and our Bank Pension Regulations are at par & exactly in the same lines with that of CCS Rules, 1972. The judgment in this case is reserved.
In this regard, Readers are also requested to refer interim orders passed by the Hon'ble SC on 31.03.2016 in Civil Appeal No's.8959-8962 of 2013 with No's.6995, 9223 of 2013, 9409-9410 of 2013 in the similar pension updation case between LIC of India Vs. Krishna Murarilal Asthana & another, directing transfer of all similar cases pending in other high courts to High Court of Delhi to take a final decision and also ordered that no other courts shall proceed with the similar matters, as it is desirable that a single judgment is passed so that the validity of the same can be adjudged.
The Hon'ble SC in the above interim orders also expressed that it doesnot require Soloman's wisdom to state that an interim order is an interim order & doesnot have any impact at the time of final verdict, especially in such a situation and, therefore directed that it shall be applicable to the similarly placed persons.THE FINAL JUDGEMENT IS AWAITED.
From the above, Similar to the plight & ordeal of Bank Retirees, even LIC Retirees are undergoing the same ordeal, but they are lucky to have a sincere, caring & strong Association to fight for them unlike our Bank Retirees.
Now, this is an appeal to AIBEA, AIBOA, AIBOC, UFBU, AIBREF, CBPRO, AIBPRA etc, to take a leaf out of the above LIC Retireees petitions & study how nicely contested, drafted final written reply submitted to the court.
Enough damage has been done to Bank Retirees. Better late than never. At least now UFBU & Retired Associations in repentance of the earlier blunders should get united & to uphold moral ethics should take remedial measures sincerely & honestly either by initiating legal proceedings organisationally as has been done by LIC Retired Officers Association or through effective negotiations in the upcoming XI BPS to protect the interest of serving & Retirees.
However, in order to continue our ongoing struggle till we get natural justice, more & more individual grievances need to be submitted on http://pgportal.gov.in to exert pressure on decision makers.
