Motion Hearing on Late MC
Singla' s case in Supreme Court is due on 04 07 2023.
In the meanwhile, Paralell to the above pending motion hearing , in the pending W.P.(C) 9679/2016, SBI Vs Pensioners, the Hon’ble Delhi High Court has also passed an interm Order on 13.4.2023. (full details of which is appended in my following Link ):

The above interim order is based on the statement as affirmed by the Additional Solicitor General representing the Government of India (DFS/MOF) before the Bench
(You are aware that SBI is a Statututary Bank enacted by the pariament for the transformation of the colonial Imperial Bank and hence the Govt. / DFS/ MOF by itself has represented through their addl. Solicitor General)

submits that in case a representation is given by the petitioners, the competent authority of Ministry of Finance shall examine the same
without prejudice to their rights and contentions and without

GENERAL FEEDBACK TO THE ABOVE :
In the case No. W.P.(C).9679/2016, SBI Vs Pensioners, the Hon’ble Delhi High Court passed an order on 13.4.2023. ( order is uploaded on the High Court website on 19.4.2023).
In the case, the Additional Solicitor General of India had informed the court that “ _in case a representation is given by the petitioners , the competent authority of the Ministry of Finance shall examine the same_ .”
The case is on the following issues :-
�1). *Revision of pension of SBI pensioners from 40% to 50%,*
�2). 100% *DA neutralisation to pre-1.11.2002 retirees* ,
&
� 3).*Pension updation*
*Now, representation has been made by the petitioners as well as others to the Ministry of Finance in terms of the Delhi High Court order.*
Let’s see what comes out from the representation.

" Yes. THE COURT ORDERED THE SBI PEN.FEDARATION AND GOP WHO HAVE FILED WPs SAPERATELY ,TO SUBMIT THE REPRESANTATIONS TO DFS MOF GOI WITH IN ONE WEEK FROM THE DATE OF THE DHC ORDER.BOTH HAVE SUBMITTED WITH IN THE STIPULATED TIME FRAME. THE COURT ALSO DIRECTED THAT THE DFS MOF GOI SHOULD SUBMIT ITS DECISION IN A FORM OF A REPORT BY 21ST JULY. IF THE PETIONERS ARE NOT SATISFIED WITH THE CONTENTS OF DFS REPORT THEY CAN APPROACH THE COURT AGAIN.
The court CAN order for retrospect or prospect.However it seems a detailed actuarial worksheet is also submitted by the GOP .The court orders can be expected by 28/7/23. Ie. with in one week after submission of reply from DFS. This is applicable only to pensioners of SBI.

In view of the foregoing, It can be construed that "parallel-polarisation" of events are taking place simultaneously towards expeditious solution - A positive development
