PENSION REVISION - PENDING APPEAL IN SUPREMEN COURT FILED BY LATE M C SINGLA  & ORS. OF PNB

You are aware that a case filed by our Comrade Late M C Singla had come up for hearing  subsequent to the Parliamentary Committee's visit to Bhubaneshwar & Kolkata on  20 09 2021 & 22 09 2021.


Consequent to the demise of our Com. M C Singla, our learned friends lead by Com. Sidhu of PNB have been pursing the pending appeal in the Supreme Court.


Considering the positive developments in the wake of the Parliamentary Committee's visit,  the petitioners sought  an adjournment  of four weeks .  

Positively respondeing,  the SC has accorded eight weeks time to enable the pirates to file counter considering the positive developments as already enunciated thereunder. - The details are as follows:

We are indeed very much indebted to our comrades from OBC who have been pursuing the legal battle  for quite a long time  exerting pressure on the Govt.. for its positive response.

UPON hearing the counsel the Court made the following
 O R D E R
 Learned counsel for the petitioners has circulated a letter seeking adjournment with the submissions that the subject matter of these petitions and claim of the present petitioners is being examined by a Committee constituted by Indian Banks’ Association on the instructions of the Ministry of Finance.

Though learned counsel for the petitioners has sought adjournment for a period of four weeks but, looking to the reasons stated, the matters are adjourned for a period of eight weeks with liberty to the parties to mention for early listing, if so required.

It augurs well with us, even though  it may  appear to be testing our patience.


As you say often  say Godess Durgamatha will definitely  answer our prayers, now both GOI and GOI may feel urgency to take a decision and file a counter in the Supreme Court by next adjournment  day.

In case the argument to be put forth by GOI gets based on its earlier stance before the Parliament in reply to members' questions, it has to rely upon the conclusions of Bipartite Settlements & Joint Notes for bringing in any improvement to pension Scheme. 


In such an event the Apex Court shall be left with the option asking the Board to exhaust the efficacious remedy that would be available through negotiations/ conclusions between UFBU & IBA and come back, if necessary, upon failure of such talks.


On the other hand , Apex Court would be under the  the obligation to follow the precedence set up by the Earlier Bench of  Apex Court on 13 02 2018 (1616-1684 CPI Points case) ruling that Settlements Joint Notes do not bind the retirees ( in case of inconsistency with the subsisting statute)  whose mandate can never be held either by IBA or by Associates of the UFBU for negotiations of any sort relating to the statutory scheme of pension  on their behalf. 


In such an event  it has to uphold the subsisting provisions under Clauses (6) & (12) of  Pension Settlement Dt 29 10 1993 under ID Act for enabling the Boards adopt the formula for updation as was sanctioned by GOI on 05 03 2019 to RBI for its implementation prospectively with effect from  01 03 2019.


Thus the dilemma for  us is necessarily between GOI  sanction for adoption of RBI formula--- or sanction of an updated formula for updation  to be implemented w.e.f. a prospective date to be specified. 


What would be the concurrence from RBI under provisions of Section 19(1) of Act 5 of 1970/1980 depends on either  IBA's adoption of formula being implemented by the very  RBI from 01 03 2019, or a new rational policy yet to be  devised by the Committee of IBA reportedly  set up for the purpose in consideration of the provisions under latest Settlement / Joint Note too

I wish to share a logic

1.Regarding pension fund position collected through RTI and Balance sheet after audit for last 2 years clearly indicates growth in pension fund by about Rs.84,000 Cr.

2. Data for bank wise pension payments and number of the regular pensioners and family pensioners are available to estimate additional load.

3. Banks improved profitabily in last two years, last year 2020-21 total profit of all PS banks was about Rs 33, 000 Crores including SBI.

4.In SC case no 5561 /2016 by Late M.C .Singhla for pension updation last hearing was on 01st Oct 21after about 4 years, learned judge has permitted adjournment for eight weeks as committee appointed by IBA is looking into the matter and their report is awaited.

5.In the last week of September 21, honorable members of the Parliamentary Committee visited Orissa and W. Bengal to take feed back from some select Bank Chairmans along with other works with State Govts, in view of reply of FM in Rajya Sabha question on pension revision.

6.Recent development is IBA ,vide their letter dated 5th October 21, has released family pension revision with provision for the amortisation for the additional load in next five years in case of difficulties in absorbing in the P&L in yr 2021-22

Therefore, developments are in positive direction and it is testing time for patience of the bank pensioners.

We need a close watch and refrain from criticism, instead all possible inputs in support of pension updation are to be shared in common platform UFBR. Thanks. I. Sanyal

Dear all petitioners , and friends, reg. Updation of pension cases pending and in progress in various high courts and only one case at SC level.

At last ,the dream of updation of pension to all retirees would come true as the SC allowed two months time to GOI DFS, IBA AND BANKS to decide .

This PUNJAB AND SIND BANK RETIREES WELFARE ASSOCIATION INITIATED THE LEGALITY FIGHT SINCE 2008 AT HC OF PUNJAB AND HARYANA AT CHANDIGARH.

we the Legal to be team at Chennai were in contact with the GEN SECY . Unfortunately the no. One petitioner was passed away and sc case was much delayed till 2021 and now the order is passed at the request of the no. One petitioner and other s to GOI DFS for two months time.

The group of retirees from syndicate bank filed in 2016 and got direction during 2017 and group of retirees from Bob SP DHANARAJ AND OTHERS FILED DURING 2018 and got direction from MHC ON
05 09 2019.

NOW THESE CASES ARE ALSO made an impact on this legal issues.

With the result the IBA INITIATED THE PROCESS NOW AND the final decision would come soon.

Let us not now frustrated any more now. Regards
