Referring to the above, Your kind attention is invited to my communication dated 19 06 2021 enclosing therewith the copy of the contempt notices served (Dated: 18th June, 2021 Ref: DSG/ASCI/082/2021) on the Government (MOF), IBA and all the CEOs of the Banks concerned at the instance of ALL INDIA RETIRED BANK EMPLOYEES ASSOCIATION, THIRUVANANTHAPURAM (Kerala).

While expressing my sincere thanks to AIRBEA for their "PRESSURE BUILDING" constructive action for our cause, I now annex their letter RSC/206/2021 dated 31 05 2021 addressed to all the above mentioned “CONTEMONORS” for Pension Revision on RBI lines as parties to CA # 6254 of 2002 filed by them.

Respected Sir/s,
Revision of pension as being effected in Reserve Bank of India in terms of orders of Hon’ble Supreme Court in Civil Appeal No.6254 of 2002.
We wish to bring to your kind notice that our Civil Appeal No.6254 of 2012 filed against the orders of Hon’ble Delhi High Court in Writ Petition was allowed on 13.02.2018 by Hon’ble Supreme Court in Civil Appeal No.5525 of 2012. This Civil Appeal No.6254 of 2012 was against the orders in W.P. (C) No. 6907/2002 between
All India Retired Bank Employees Association & Ors Vs Union of India & Ors, which was disposed off by the Hon’ble High Court of Delhi on 30.03.2012. We are enclosing copies of the Judgment/orders in Civil Appeal No.5525 of 2012 & connected matters including Civil appeal No.6254 of 2012 and W.P. (C) No. 6907/2002.
Following are among the prayers in our Writ Petition No. W.P. (C) No. 6907/2002 :
(d) To issue writ or direction directing the respondents to grant the benefit of pension to the members of the Petitioner Association as being paid to the retired employees of other Public Sector Undertakings, namely, LIC and RBI ;
(e) To issue writ or direction directing the respondents to recognize the Petitioners Association in any meetings/conferences/settlement as and when any issues/decisions are decided/taken for/against their behalf ;
This Writ Petition (C) No. 6907 travelled to the Hon’ble Supreme Court as Civil Appeal No. 6254/2012 (which arose out of SLP (C) No. 24525/2012) which was ultimately allowed on 13.02.2018. This was tagged to Civil Appeal No. 5525/2012 between Bank of Baroda & Ors Vs G Palani & Ors. Union of India and all Public Sector Banks were Respondents in the Civil Appeal No.6254/2012. Consequently, all are bound by the decision of the Hon’ble Supreme Court, which has attained finality.
In terms of the orders of Hon’ble Supreme Court, members of our Association are entitled to the benefit of revision of pension as approved by the Government of India vide Letter No.F No.11/5/2001-IR dated 05.03.2019. We request you to direct all member Banks to extend this benefit of revision of pension effected in Reserve Bank of India to its pensioners to all Bank pensioners, as revised in Reserve Bank of India by adopting the same formula for revision of pension.
The 11th Bipartite Settlement and 8th Joint Note were signed on 11.11.2020 and in terms of orders of Hon’ble Supreme Court, representatives of our Association should have been a part of the discussion/understanding. It is unfortunate that representatives of our Association were also not a part of the Settlement/Joint Note dated 11.11.2020. This is in violation of orders of Hon’ble Supreme Court in Civil Appeal No.6254 of 2012 dated 13.02.2018, attracting action under Contempt of Courts Act, 1971.
We request you to kindly pass appropriate orders in this regard and arrange for immediate revision of pension in terms of orders of Hon’ble Supreme Court. This is without prejudice to the pending Contempt Petition which is pending for listing. The Diary Number of the Petition is 13216/2020.
