Dear Sir/Madam,

Neglect of instructions of the Ministry of DARPG by other Departments/Banks etc.


Your kind attention is drawn to the following:

The Ministry has from time to time issued instructions to all Directors of Grievances all Ministries and Departments to acknowledge grievances to the aggrieved within three days of receipt and to redress them in a time frame of two months.

The Under Secretary, Government of India Ministry of Finance
has forwarded the extant guidelines to the Chief Executives of all Public Sector Banks, RBI and to Indian Banks’ Association, Mumbai, making the guidelines applicable to them also.

It is astonishing that the Department of Financial Services, Ministry of Finance ( DFS) had been, ingross neglect of all the instructions, accustomed not to acknowledging any of the grievances notwithstanding that they related pension to Senior citizens and merely forwarding such grievances to Indian Banks’ Association (IBA) or to the concerned bank after keeping the grievance in cold storage for long periods and not redressing them within the time frame though matters contained in the grievance is to redressed by the Department and knowing perfectly well that neither Indian Banks’Association nor the concerned bank can do anything g in the matter.

To cite an example, my representation No.201215 dated 15.12.2020 on updating of pension in Public sector Banks was not acknowledged and was forwarded by DFS to IBA on 02.03.2021 vide letter No. 10/03/2021 detaining it for about 72 days without doing anything on it. The delayed act {without acknowledging and redressing} was done only after submitting an online application RTI Act on25.02.2021 which was registered with the No. DOFSR/R/E/00258/1.

What was more surprising is that the redress of the grievance could be done only by DFS and IBA could do nothing without the
instructions of the Ministry.

IBA a non-state entity is keeping mum in the matter.

The DFS initially operated as a “Dead Letter Office” and later as a Post Office in transmitting the grievance to the IBA in gross neglect of the extant instructions for redress of grievances.

The instructions of DARPG went a travesty turning the Ministry into scare crow.

I am attaching copies of my grievance, and of the letter F No.15/573/2015-IR dated 19.03.2021 sent to me after 22 days of receipt of the application under RTI seeking information on my letter dated 15.12.2020 making things a mockery and with a fervent appeal to you to do the apposite in the matter, under intimation to me.

                   UPDATING OF PENSION IN BANKS.

Bank Employees’ Pension Regulations, 1995 lays down in regulation 35 (1) that “Basic Pension and additional pension, wherever applicable, shall be updated ….” and regulation 56 states that the Pension Regulations are similar to Central Civil
Pension, {which gets updated with the implementation of each Pay Commission}.
Hon’ble Supreme Court held on 01.07.2015 that pension shall not be lower than 50 percent of the running pay bands corresponding to the pre-revised scales of pay in Civil Appeal No.1123 of 2015 viz. State of Rajasthan &amp; Anr. Vs. MahendranathSharma &amp; Ors.

This is in a scenario where pension is payable with cost to “state”out of the common fund of India. Revision of pension in banks is with no cost to government as it is out of the Pension Funds which comprises the money and deferred wages of employees. Hon’ble Minister for Finance advised the Chairmen of IBA and of State Bank of India that banks shall treat their ex-employees fairly and OROP shall be considered for them. In spite of everything, updating of pension in banks, which is pending for decades, is not cleared and IBA is reportedly examining the cost aspect of updating. This is in gross disregard to the Pension Regulations, ruling of the Supreme Court and the instructions of the Hon’ble Minister in a situation where Pension Funds of all banks are generating income sufficient to pay more than double the present pension to all.

I request you to instruct banks /IBA to update pension of employees as mandated by the Pension Regulations and the ruling of the Hon’ble Supreme Court, since the matters are overseen by IR Department of the Ministry, to prevent the efforts of IBA to thwart the Pension Regulations, law of the land laid down by the apex court of India and the advice of the Hon’ble Minister for Finance. 


This is essential as the failure to do so will render all concerned contemnors of {Supreme} Court. 


Kindly do it expeditiously.
