At the outset, we congratulate for the valiant efforts made by United Forum of We Bankers  challenging IBA's refusal to talk to them .

"...It is evident from the material brought on record that in
another set of conciliation proceedings between Indian
Bankers Association representing the management of
Banks, which are parties to the Bipartite Settlement and
Workmen's Union and Officers Association, a written
settlement has been arrived at on 22.7.2020. However, it
seems that the settlement is not acceptable to the
Employee's Unions coming under the petitioner......

....On matter being taken up today, learned Additional
Solicitor General of India has placed before this Court an
order dated 3.11.2020 passed by the Central Government
making a reference under Section 10 of the Act. The
reference is in following terms :-
"Whether the refusal of the Indian Bank's Association in
not entertaining the demands of United Forum of We
Bankers Kanpur is justified and whether this can be
entertained as Industrial Dispute. If not, what relief and
what directions if any, are necessary in the matter

Sri Rakes Pandey, learned senior counsel assisted by Sri
Ashutosh Sharma, appearing for the petitioner Association
expressed certain doubts about scope of the reference.
Be that as it may be, since a reference has already been
made, therefore, this Court finds no good reason to keep
the instant matter pending.
It is accordingly disposed of but without prejudice to the
right of the petitioner to challenge the terms of reference if
advised.
