My Dear Friends,

PAYMENT OF COMMUTATION ARREARS  - :JUDGMENT OF HON'BLE SUPREME COURT dtd. 13 02 2018 IN CIVIL APPEAL 5525/2012 AND CONNECTED MATTER (COMMON PROCEEDINGS) IN CIVIL APPEALS #1892-1912 IN SLP(C)#023777-023797/2012 BETWEEN SYNDICATE BANK  Vs. D. SRINIVASA MURTHI & Ors. - PAYMENT OF ARREARS 
I furnish here a few note-worthy points of my letter of  3rd. reminder dated - July 11, 2018 addressed to my management of  Syndicate Bank for the payment of commutation arrears together with int @9% as order by the Hon'ble Supreme Court  IN THE ABOVE CA.   Here I draw your specific attention to the certain points of my letter much  in particular: -ie:-

".......During the pendency of my above WP-ie. During 2009, in terms of the Orders of the Honb’ble Supreme Court of India, as also directed by IBA, you had revised the Basic Pension to all the pensioners under the VRS 2001 by applying notional service as per their eligibility which incidentally happened to be my first prayer.  

"HOWEVER,   GLARINGLY, IN MY CASE, YOU DID NOT RELEASE THE ARREARS TO ME AS ENVISAGED  IN THE SUPREME COURT JUDGMENT ALONG WITH OTHERS WHO WERE ON EQUAL FOOTING, AND INISISTED FOR MY WITHDRAWAL OF THE SUBJECT WP VIDE YOUR LETTER REF.No. 3716/SWD/PEN/WP/2009 DATED 20th.NOVEMBER, 2009 AS A MATTER OF PRE-CONDITION FOR THE RELEASE OF THE ARREARS AT THAT PARTICULAR POINT OF TIME.  SINCE THE SECOND PRAYER OF MY ABOVE WP WAS STILL UNRESOLVED, I DID NOT ACCEDE TO YOUR ABOVE PRE-CONDITION.  HOWEVER, YOU RELEASED THE SAME BELATEDLY AFTER PROTRACTED CORRESPONDENCE IN THIS REGARD.

YOUR  ABOVE ACTION STANDS AS AN OCULAR PROOF OF YOUR VINDICTIVE ATTITUDE TOWARDS ME FOR THE SIMPLE REASON OF MY KNOCKING THE DOORS OF JUSTICE FOR THE SAKE OF JUSTICE ALONE......."


The Hon’ble single bench of the Karnataka High Court, Bengaluru pronounced the common judgment in my favour allowing both the prayers as stated above on 21st. April, 2011 in my WP#41751/2001 along with WP#15295/2001 (common proceedings).  
WHILE DISPOSING  OFF THE MANAGEMENT'S APPEALS IN THE WA # 4901 OF 2001 ON 8th. MARCH, 2012, THE OBSERVATIONS MADE BY THE HON'BLE DIVISION BENCH OF THE KARNATAKA HIGH COURT COMPRISING OF  HON'BLE  SRI VIKRAMJIT SEN, CHIEF JUSTICE  &  HON'BLE Mrs.JUSTICE B. V. NAGARATHNA, IN THEIR REMARKS, ARE INDEED WORTH NOTING. 


".....Please do not compel me and my friends to approach Hon’ble Supreme Court by filing Contempt proceedings.  Do I have any other option, when authorities at helm of affairs turn deaf ears and feel proud by denying legitimate benefits?   How, whole world, which has shrunk on account of communication and media (electronic/print), would view, when this information is circulated ?   I am enclosing the extracts from the Judgments and Pension Regulations, which are relevant to issue on hand along with my earlier correspondence concerning the issue.    ..."
".........“Regulation 37: 37. Dearness Relief: -  
(1) Dearness relief shall be granted on basic pension or family pension or invalid pension or on compassionate allowance in accordance with the rates specified in Appendix II.  
(2) Dearness relief shall be allowed on full basic pension even after commutation.”

MY DEAR FRIENDS,

YOU ARE QUITE AWARE  OF THE FACT AS TO HOW THE   TOP MANAGEMENT OF SBI  SUFFERED A  BITTER HUMILIATION  BY TENDERING UNCONDITIONAL APPOLOGY BEFORE THE HON'BLE SUPREME COURT  FOR THEIR OWN DELEBERATE ACTION OF DEFYING THE COURT ORDERS....

LET THIS STRONG MESSAGE BE SENT TO THE OTHER CEOs OF PSBs AS TO THE  BITTER CONSEQUENCES THEY TOO MAY HAVE TO  FACE,  IF THEY DARE TO  DEFY THE COURT ORDERS 

SHORTLY, I AM ALSO TO ADDRESS A FINAL REMINDER TO MY MANAGEMENT OF SYNDICATE BANK  AKIN TO THAT OF COM. PRASAD'S LETTER TO SBI MANAGEMENT.
