

PAYMENT OF COMMUTATION ARREARS TO PRE-2002 RETIREES

In continuation to the above, I take immense pleasure to forward the valuable inputs / observations made by our
learned senior comrade viz: Sri C N Prasad garu, who caused to file the Contempt Petition in the above case - 1616-1684 DA arrears arising out of the Judgment passed by the Hon'ble Supreme Court on 13 02 2018. In the case of the erstwhile associates of SBI, they were not even given the benefit of 5-year notional service in addition to the difference in DA which may please be noted.
In the above Contempt Petition, the mode of calculating interest component as per the court's contention / procedure is duly highlighted enclosing there with a calculation sheet in the Excel format citing as an example. (Click the link) ;

Dear friends,
There is no difference between Supreme Court Judgment and this Judgment of Madras High Court. In fact, Madras High Court has reiterated.the applicability of Supreme Court Judgment in respect of payment of Dearness Relief. This aspect is a part of Contempt Petition filed by members of our Commune. We are extracting relevant portion of our petition, hereunder :
c. Computation of Dearness Relief in terms of Regulation 37 of Bank Employees Pension Regulations, 1995;
d. Payment of Commutation on differential amount of Basic Pension in terms of Regulation 41 and 56 read with Rule 6
and 10 of Central Civil (Commutation of Pension), 1981;
e. Interest on the total amount due and payable at 9% as on the date of payment, as directed by this Hon’ble Court;
We are confident of securing these benefits through our Contempt Petition. Next date of hearing is likely to be on the 15th July, 2019. We are working in tandem with Shri Vasudevan. As per our Calculation, arrears amount due and payable, including what has been received is between Rs.15.00 lakhs and Rs.25 lakshs, with increase of pension by Rs.5,000/- per month. It is only SBM Pensioners' Commune which has filed Contempt Petition. We have already spent over Rs.8.00 lakhs for Contempt Petition alone.
Method of calculation of Interest is wrong. We have consulted Justice Nagmohan Das, Retd. Judge of Karnataka High Court and Shri M Nagaprasanna, Senior Advocate who has won our 1616 - 1684 case and also Pension issue of Gramin Bank employees/retirees. Both of them have opined that the method of calculation of interest is wrong. Order provides of calculation of interest on 'amount', i.e single amount. Which means, interest has to be calculated on the total amount payable, on the date of payment. The difference in the method of calculation of interest is Rs.3.00 lakhs to Rs.6.00 lakhs. Please go through the Judgment of Hon'ble High Court of Karnataka. Shri Sadashiv Shetty and Mr.Gowda of Vijaya Bank were present along with us in Karnataka High Court. No other respondent was represented and no one else was present in any of the days of hearing in Karnataka High Court. Our first batch of petitions was filed in the year 2002.
In Hon'ble Supreme Court, Shri Rajendra Bab and G Palani of BOB, Shri Purohith of AIBREA and we were present during the hearing and no one else. Only SBM Pensioners' Commune has filed Contempt Petition. We are engaging best legal brains.
We would provide further details in due course. Commutation is now being paid on account notice served on Shri Rajnish Kumar, Chairman, SBI in our Contempt Petition. Not on account of any other efforts.
