PARLIAMENT SECRETARIAT RESPONDS TO OUR PETITION

My Dear Friends,
Your kind attention is invited to my earlier communication (dtd. March 09, 2019 ) informing you that any amendment to the pension regulation necessarily need to be placed before the Parliament for its approval by giving a Notification for amendment by the concerned Banks individually duly certifying that "BY BRINGING THE PROPOSED AMENDMENTS RETROSPECTIVELY NO INTERESTS OF THE RETIREES AFFECT ADVERSELY. This certification is mandatory on the part of the concerned Banks individually .
The proposed amendment/s are invariably subjected to scrutiny by the MOF and forward the same with its authentication to the Parliament Secretariat to place before the Parliament through the "Committee on Subordinate Legislation of the Rajya Sabha " who totally rely on the above certification made by the Banks/MOF
THE AMENDMENTS WITH WRONG CERTIFICATION ARE UNTENABLE AND ULTRA-VIRES.
IN FACT, WE HAVE BEEN WORKING OUT ON THIS STRATEGY TO EXPLORE THIS AVENUE FOR SPEEDY JUSTICE TO THE LAMENTING LOT OF OUR FRATERNITY.
Accordingly , in an effort to bring the same to the notice of the Committee On Subordinate Legislation of the Parliament to initiate action (Arbitration) , our learned friend - Sri C N Venugopal of Kerala had already represented vide ref.No.225:18 dated 05th Februay, 2019.
Responding to the above, Rajyasabha Secretariat initiated action calling for the comments/clarifications of the MOF besides furnishing the updated copy of the said regulations notification dated 6th.Nov.2017 for placing the same before the Committee on Subordinate Legislation, Rajya Sabha for taking a view on the matter vide ref.No.RS 15/3/2019-COSL dated 15th.Feb.2019.
Our Learned Comrade Sri C N venugopal has today again reminded to the Rajya Sabha Secretariat vide ref.No.149:19 dated 11th. March, 2019 inviting their kind attention specifically to the explanatory memorandum pertaining to the Gazette Notification dtd.06 11 2017 as forwarded by the Union Bank of India wrongly certifying that :
"....Therefore interest of no person shall be adversely affected by such retrospective effect."
In the above reminder , the attention of the Rajya Sabha Secretariat has been focused, with much stress on the observations made by the Hon'ble Supreme Court in its latest judgment in 1616-1684 DA Case saying:
"....The amendments cannot evolve as regulations as they are inconsistent with the Pension Scheme and the certification in the explanatory memorandum that interest of no person shall be adversely affected by such retrospective effect is false. ..."

UNMINDFUL OF THE INACTION ON THE PART OF OUR RETIREE ORGANISATIONS FOR A CONSTRUCTIVE ACTION, LET US HOPE OUR INDIVIDUAL EFFORTS WOULD BRING THE DESIRED JUSTICE TO THE LAMENTING LOT OF OUR FRATERNITY AT THE EARLIEST.
