My Dear Friends, RE: CONTEMPT PETITION FILED BY SBM RETIREES/COMMUNE IN SUPREME COURT – AIBRF’S RECENT COMMUNICATION –REF:2018/73 DATED 25 07 2018 https://drive.google.com/file/d/1Dua8DYEjbZgpfQpqNvKFpaCHginpj-32/view?usp=sharing As per the above communication, The SBM Pensioners Commune have filed Contempt Petition in Supreme Court for not complying with the Court Orders by the bank management , as pronounced in it’s Judgment dated 13th. February, 2018 in the matter of 1616-1684 DA issue. My hearty congratulations to Com. C. N. Prasad and his team for taking up this 17-year old matter to the Highest body of the Judiciary , for its logical conclusions in the sole interest of justice and fair play -- This alone would bring solace to the lamenting lot ultimately. Though many other banks have disbursed the arrears, the same have not been in conformity with the orders of the court- viz: 1. Commutation arrears together with interest component has not been passed on to the eligible retirees as ordered. 2. No uniformity has been maintained by the banks while implementing the orders. They have done away with the established norms/practices in the past, while implementing orders of the country’s highest body of Judiciary. ------------------------------------------------------------------------------------ WHO CAN FILE REVIEW –OR- CONTEMPT PETITION /S ???- IN THIS CASE, ONLY THE AGRIEVED PARTIES TO THE LITIGATION CAN ALONE FILE CONTEMPT PETITION INDIVIDUALLY. (THAT’S HOW, EVEN IN 100% DA CASE (WHICH WENT AGAINST US), IT IS THE UNITED BANK OF INDIA RETIREES WELFARE ASSOCIATION WHO FILED THE REVIEW PETITION IN THE APEX COURT, BEING THE PARTY TO THE LITIGATION.) ------------------------------------------------------------------------------------ IN THE INSTANT CASE, WHILE DISPOSING OFF OUR MANAGEMENT’S APPEAL IN WA# 4901 OF 2001, ON 8th. MARCH, 2012, THE FOLLOWING REMARKS/OBSERVATIONS MADE BY THE HON’BLE DIVISION BENCH OF KARNATAKA HIGH COURT COMPRISING OF HON’BLE VIKRAMJIT SEN, CHIEF JUSTICE & HON’BLE Mrs.NAGARATHNA, ARE INDEED WORTH NOTING: QUOTE: “...... WE MENTION THIS FOR THE REASON THAT IT APPEARS TO US THAT THE EXTREMELY SCARCE TIME OF THE COURT AS WELL AS THE BANK’S RESOURCES HAVE BEEN AVOIDABLY AND UNNECESSARILY EXPENDED ON AN EXERCISE OF FUTILITY.......” Sd/- JUSTICE. June, 2018 followed by latest one dtd. 21st.July,2018 (We are also covered under the same common judgement) In the wake of the SC Judgment dtd. 13 02 2018 in CA5525/2012 and connected matter in CAs#1892-1912 in SLP(C)s#023777-023797/2012 (filed by Syndicate Bank), I have addressed a letter dtd.11th.July,2018 to the management. Till date, we have been pursuing the legal battle as the petitioners spending money from out of our own pockets, all these 17 long years without anybody’s support –who so ever. Now the benefits have accrued to many of our friends - even without their participation/turmoil , in this long drawn legal battle for over 17 years. I am very happy about our achievement so far. Now that, many of our friends have already been benefited financially, It's upto them to come forward voluntarily to support me/us financially to file petition for contempt proceedings which will further accrue in the form of additional benefit ( much more equivalent to the sum that has already been received by our eligible retirees so far. ) I append here the link for the communication of appeal dated 20th.
