Home Should Mean Safety — Introduce a Balanced Castle Law in Victoria
The issue
Imagine being at home, the place where you and your family should feel safest, and suddenly being confronted by an intruder who threatens that sense of security. For some Victorians, this is not simply a fear but a frightening reality that can leave lasting emotional and psychological consequences.
In those moments, a parent is not thinking about complicated legal principles. A father or mother is thinking about protecting their children. A husband or wife is thinking about protecting their partner. A person living alone may have nobody else to rely on. When every second matters, people should have clear confidence about their right to protect themselves and those they love.
I am raising this petition not only as a member of the Victorian community, but as a father, a husband and a son. Like so many others, I want to build a safe and peaceful life for my family in Victoria. I want my children to grow up knowing that their home is their safe place. I want my wife, my parents and every family in our community to feel secure behind their own front door.
Under current Victorian law, self-defence is recognised, but people can still be left with uncertainty about how the law will apply after a traumatic home invasion. Someone who has just experienced one of the most frightening moments of their life should not also be left wondering whether reasonable actions taken to protect their family could later expose them to serious legal consequences.
We are therefore calling for the introduction of a balanced Castle Law in Victoria.
A balanced Castle Law should provide clear and reasonable legal protection for people who genuinely act in self-defence, or in defence of another person, when confronted by a violent intruder inside their home. A person should not be expected to retreat from their own home when they reasonably believe they or their family are facing an immediate and serious threat.
This proposal is not about encouraging violence, revenge or excessive force. It is not about giving anyone an unrestricted right to harm another person. Any reform should contain strong safeguards requiring defensive actions to be reasonable and proportionate to the threat faced.
The purpose is simple: greater clarity, fairness and protection for ordinary people placed in extraordinary and terrifying circumstances.
Our homes are where our children sleep, where our families gather and where we should feel most secure. The law should recognise the unique and frightening reality of an unlawful home invasion and provide clear protection for people who reasonably act to keep themselves and their loved ones safe.
As a father, husband and son, I want the same thing that countless Victorian families want: to live peacefully, raise our families safely and know that if the worst ever happens inside our own home, the law will fairly recognise our right to protect the people we love.
Please sign this petition and ask the Victorian Government to consider and introduce a fair, carefully balanced Castle Law that protects families, preserves reasonable self-defence safeguards and gives Victorians greater confidence that their home can truly remain their safe haven.
Protect Victorian families. Protect our homes. Introduce a balanced Castle Law in Victoria.
