Hold Billerica accountable: Demand justice for the Deoliveira family

ATTENTION BILLERICA RESIDENTS! The multiple lawsuits involving the Town of Billerica and the Deoliveira family are STILL ongoing, as is the flooding! You likely saw this story was featured on Channel 7 Investigates back in February https://whdh.com/7-investigates/7-investigates-flood-of-concern/ What you may not know is that the Town is still fighting them in court for something their negligence created. 7 more months of damage have gone by since we all saw this. This week, the Billerica Conservation Committee was reviewing a request for Certificate of Compliance from #423 Middlesex Turnpike (their neighbor’s home that is sitting on an easement.) This property has been lived in without a Certificate of Compliance since 2015. As resident’s, we had the right to attend this meeting and voice our concerns. However, all of us in attendance were denied the opportunity to speak during public comment by the Committee, specifically by Director Isobel Tourkontonis.
The owner of #423 Middlesex Turnpike has openly admitted to violating the Order of Conditions issued by the Town of Billerica. In addition, they failed to disclose that an easement for a drainpipe runs directly across the location where they built their addition. It’s also public knowledge that the property at 423 is entirely in a flood plain and abuts wetland and conservation land. No other resident would be allowed to build something like this. No other resident would be treated the way the Deoliveira family has either. So why is this happening? The real questions that we need be asking to the Town are this:  
Why is the Town allowing the owner of 423 Middlesex Turnpike to live in a home for 9 years without a Certificate of Compliance?  
Why isn’t the Town enforcing the Order of Conditions for 423 Middlesex Turnpike? How is #423 Middlesex Turnpike still standing on an easement 9 years later? Why is the Deoliveira family up against both the town and homeowner of #423 together in court? How was #423 allowed to get a permit to add solar panels this Summer onto a house that hasn't been signed off on? How much has the Town spent in these lawsuits trying to hide this? Why did the Town dig up the Deoliveira’s backyard, proceed with tests on the pipe, and get quotes to fix this in 2021 if they didn’t plan to step in? Who prevented this from moving forward in 2021?
How much did the digging and tests cost the taxpayers? Why isn’t the Town suing the architect and Dresser Williams and Way for failing to do their jobs in identifying a clearly documented easement? Why isn't the town suing our previous attorneys for unethical conduct that keeps being mentioned in meetings? Why isn't the Town suing our previous Town Manager for ignoring this blatant disregard of our bi-laws and leaving this family to drown? Why is the Town still using this drainpipe for their runoff of Stearns Lane knowing the water is ending up at the Deoliveira’s? 
The Deoliveira family has tried to come to a solution with the Town of Billerica so they can move on with their lives, after nearly a decade of horror. It appears however that they have been informed that the Town will continue to take no ownership of this families 9 years of damage to their property. 

With 5 members of a Select Board, and a new acting Town Manager, we need to know who is against helping this family. THE VOTERS WANT NAMES! These meetings and this information will eventually be released to the public. 

Which Town employees or representatives have spoke with this family over the years? Which Town employees or representatives have come to look at their property? Which Town employees or representatives promised this family a fix at any point? Which Town employees or representatives have known that their young daughter has been medically affected and stood by doing nothing? (Seems parts of their daughter’s medical history was evidence.) It does not appear that their daughter’s name is included in any lawsuits, as a Plaintiff, for those damages either. 
Our understanding is their next court hearing is to be heard Thursday the 19th at Lowell District Court. This hearing is asking the court to demand the Town of Billerica enforce their own issued Variance. We, as taxpayers, are paying for this court case asking the Town employees to do the jobs they are already paid to do. Why are they not doing it? What are they hiding? We need to continue to show up at these meetings as well as court hearings in numbers. Multiple residents plan to move forward with an investigative reporter regarding the corruption and negligent use of our tax dollars. 

Please sign this petition if you are a Billerica Resident who feels strongly that the Town of Billerica should stop spending our tax money in hopes that they might cover up this huge mistake.
