APPEAL TO LIFT THE BAN AND REVERSE THE VISA DECISION

My name is Wojciech Cywinski, I am 28 years old and I come from Warsaw, Poland. On the 18th of March 2016 I have joined Emirates Airlines and I arrived to Dubai to make my dream come true. I have always dreamed of living in Dubai and flying for Emirates Airlines since I was a child. Dreams are priceless and worth fighting for therefore I did everything that is possible to reverse the decision. I visited every department in Dubai that could potentially reverse the decision including the Ministry of Health, the Dubai Health Authority and the UAE Embassy. After a year from this event I have received no response of any kind, my ban is permanent - meaning for life, and I cannot enter Dubai as a tourist even if I have been there 3 times in the 2015 before arriving to work there in the 2016.

I have been subject to the utmost discrimination in Dubai after receiving the denial of the residence visa and being banned by the ministry of interior to re-apply stating that I am unfit to work and live in the UAE due to a supposed “old TB scar” while I never had TB in my life and all my tests for TB are negative.

During the arrival phase I have undergone through all possible tests at the Dubai Health Authority. Standard blood test – negative, sputum test – negative, Mantoux tuberculin skin test – negative and finally T-Spot Tuberculosis test – negative. There is no proof of TB of any kind. Just fake conclusion of Dr Hassan Md Shurie. Your residence in Dubai depends only on this one man decision. With all the international responsibility I am declaring Dr Hassan Shurie the biggest fraud of Dubai, going against the entire medical authority in the world including the Dubai Health Care City as the highest medical authority in Dubai put in place to restore confidence in the system.

 

Dubai Health Authority has questioned my health condition upon a scar on my right upper part lung scar stating it is an old TB. In order to change the decision of deportation my doctor from Emirates Airlines was asked to present proof that this scar is not from TB to give the medical clearence for the residence visa. I was directed to do two Quantiferon TB Gold tests – one in Emirates Clinic and one in Mediclinic City Hospital from the Dubai Health Care City appointed as the highest medical authority by the Ministry of Health. Both results were Negative. People with a negative Quantiferon are considered healthy and not being in touch with the TB bacteria in their lifetime. It is the utmost proof when dealing with TB. To acknowledge that, Dr Hassan Shurie – Head of Technical Service at the Dubai Health Authority – directed me to repeat the same test at the DHA. He spoke with my doctor by the phone and said “If his T-SPOT Tuberculosis test is negative, I will pass his clearence”. Two days later the result was Negative, but he maintained the decision of the ban and deportation. People with negative Quantiferon are getting UAE visas because this test is of the utmost importance showing that there is no hidden / latent TB. You cannot have a hidden TB if you never contacted TB bacteria. Therefore a negative result gives the permission to issue the visa in every jurisdiction including United States of America, Australia and the European Union. And thousands of people in the UAE got the residence visa when proving that their Quantiferon TB Gold test is negative.

 

This decision is so frustrating to me and so heavy, because it has taken me away from my dreams and now it is impacting my entire life, development and happiness.

Dreams are priceless and I will do everything to make them come true. After deportation I have gone to the most important people in Poland to certify that I never had TB. And I have two medical consultations from:

1.       Professor Maria Korzeniewska-Kosela – the most important person in Poland,  Head of the National Tuberculosis and Lung Diseases Research Institute in Warsaw stating it is very unlikely that I ever contacted TB as all the tests are negative and that I am considered 100% healthy for any jurisdiction in the world;

2.       Professor Michal Pirozynski – the best accredited pulmonologist in Poland and enlisted in the USA for practice with an American title, stating that my scar is a very old scar and likely coming from a different reason during childhood as all the tests are negative. Thanks to this proof everywhere in the world I am considered a 100% healthy person eligible for the visa with a clear history.

 

Both of them have issued a medical opinion stating that the scar is not coming from TB because all the tests are supporting evidence of that. If anyone of them would be positive at some point it would give some indication, but not in the case when all are negative. My Health Card Nr 120710137 will give you access to all the results in the Dubai Health Authority IT System. The blood test, sputum test, tuberculin skin test and T-Spot tuberculosis test are there in the system and they are all Negative. This is the evidence that I have never contacted TB in the past. The scar is coming from another inflammatory origin during childhood and I was vaccinated against TB as soon as born.

 

Being denied the visa, deported and banned for life while being healthy with no TB in the past it is a fraud case. Dubai is supposed to be the world’s leader in the healthcare industry, however its laws are behind any developed accreditation. There are thousands of other people legally working and living in Dubai with negative results on TB. There are even those with positive results on TB and HIV legally visiting UAE and infecting all the current local population.

According to the law, if the patient is showing no history of any communicable disease (HIV, Hepatitis B, Syphilis and TB) it is eligible for the UAE residence visa and acknowledged fit to work. So here I am with all the evidence of negative results. The denial decision is against the UAE law and against the international standard that the World Health Organization is fighting for not discriminating people in the United Arab Emirates.

 

To HH Sheikh Mohammed bin Rashid Al Maktoum:

People in my case are allowed to stay in Dubai as they are free of any infection and have a clear history. Showing strength and success outside the country while discriminating people in your own Dubai is embarrassing and undermining your own authority. It is a matter of humanity, brotherhood and international reputation. In 2016 you have made an amendment to the Law in which people having their dependents working in the UAE are eligible to an exemption for the UAE visa with scars. If dependents with history of TB and tourist can come to your country and stay, live and spread the diseases than what is the real meaning of deporting and banning people who are 100% healthy with no past history of TB?

I have received a permanent ban from the UAE Immigration Authority not allowing me to enter the country even as a tourist for life. I have been in the UAE three times before coming to work there. There was no medical check up or any other obstraction to enter as a tourist. Suddenly, when I wanted to work in Dubai, I was deported and banned for life. 

May I ask you to reverse the decision of my application, lift the ban and approve all the visas for the future, as it is a fraud case. Meaning your law needs further amendments, your reputation is undermined by the fraudulent environment of the Dubai Health Authority and the entire Dubai mirage is a fraud in its inception standing against the international agreements.

You have said in the past that the only way you will change the Immigration Law is in the case when an other country in the world will ban the same way UAE citizens.

I am working and leaving in Switzerland where I am considered 100% healthy and fit to live an work. Is Dubai a better expert than Geneva? Dr Mario Raviglione from the World Health Organization - STOP TB Department, has tried to intervene in my case, but there is no response even to his appeals. There is just one conclusion: Dubai Health Authority is a fraud, as it is Dr Hassan Shurie and HH Sheikh Mohammed bin Rashid Al Maktoum, the Prime Minister and the Ruler of Dubai. Big Fraud.

Technical description

After finding a scar I have gone through all the procedures and tests trying to spot the TB infection upon which the visa was denied. However all the tests are negative. And here is the timeline of my tests.

 

18.03.2016 – Arrival to Dubai.

21.03.2016 – Medical Examination at Emirates Headquarters  - all kind of tests – blood, urine, x-ray etc.

10.04.2016 – Repeated X-Ray at the Dubai Health Authority (DHA) – stating there is a scar of old TB.

My Health Card Number: 120710137. You can find all my tests negative in the IT system at the Dubai Health Authority.

 

19.04.2016 – Standard blood test for TB at DHA – negative.

19.04.2016 – First Sputum test at DHA – negative.

20.04.2016 – Second Sputum test at DHA – negative.

21.04.2016 – Third Sputum test at DHA – negative.

23.04.2016 – Mantoux Tuberculin test at DHA – negative (DHA’s doctor said “if it’s negative, it is good for you”)

30.04.2016 – Decision – Denial of the residence visa (upon no proof of TB).

01.05.2016 – Emirates Airlines hands me the Termination of my contract according to the government decision.

Dr Hassan Shurie – the Head of Technical Service at Dubai Health Authority asked for proof of no TB infection in the past to give the clearance for the visa. Emirates Clinic is trying to prove that I never had TB.

 

01.05.2016 – PROOF NR 1. Quantiferon TB Gold test (IGRA) done at Emirates Clinic for hidden TB – negative (stating I never had TB as I was never infected, never gone through a special cure for any lung diseases and there is no latent/hidden TB in my blood, which can only be positive if ever contacted TB infection in the past therefore it is proof of not being exposed to TB in my life. People with negative results were given UAE visas in the past).

 

02.05.2016 – Referral to the Dubai Health Care City – Mediclinic City Hospital in Dubai for private tests.

02.05.2016 – X-Ray – Mediclinic City Hospital Dubai – there is a scar.

02.05.2016 – CT Scan – Mediclinic City Hospital Dubai – computed tomography showing the details of the scar

02.05.2016 – PROOF NR 2. Quantiferon TB Gold test (IGRA) at the Mediclinic City Hospital – negative (stating I never had TB)

09.05.2016 – PROOF NR 3. TB Spot test (equal to Quantiferon TB Gold) at Dubai Health Authority – negative (I never had TB).

12.05.2016 – Decision should be changed according to what Dr Hassan Shurie said in the first place, however the decision was maintained and I had to be deported and banned with my eyes scanned even though I have presented proof of no TB in the past.

17.05.2016 – Deported to Warsaw

26.05.2016 – The National Institute of Tuberculosis and Lung Diseases – stating that I have no signs of TB from the past and that according to all the tests Quantiferon undertaken in Dubai, the X-Ray and CT Scan the scar is not possible to come from a TB infection and give negative results.

21.06.2016 – Professor Michal Pirozynski giving me a medical consultation stating the I never had TB in the past and the scar is an old scar from a different inflammation. He said that I am not the first case that was denied the visa in the UAE, but with all these evidence I should get the visa as others have succeeded.
