I am pleased that we seem to have had some headway lately around stalking and domestic violence laws. In December 2016 stalking orders were introduced so if a prosecution is going ahead, the order can protect victims while evidence is being collected. A good step and one that is now inline with domestic violence orders.
Then in January 2017 we were successful in increasing stalking sentencing from a maximum of 5 years to 10 years.
All good news but still I ask does it go far enough?
What do we know about stalking?
1 in 5 women and 1 in 10 men are stalked in their lifetime.
The National Stalking Helpline has responded to almost 14,000 calls since it was established in 2010 with over 3550 in 2016
Still few stalking cases result in prosecution.
There is a lack of investment around specialist led training of criminal justice professionals; in particular the CPS, Magistrates, Judges and court staff. This often means patterns are missed, the behaviour escalates as it is not dealt with. The fixated behaviour continues and more victims accrue.
What do we know about offenders of this crime?
Do they often re-offend? Yes, 55% of stalkers go on to re-offend and 36% had a previous conviction for harassment.
This behaviour becomes engrained in these individuals if their behaviour is not managed.
There is a clear need for a serial stalker and domestic abuser register. Just as sex offenders are proactively identified and managed, serial offenders of stalking need this supervision so their behaviour is managed and they can be tracked.
Prime Minister Theresa May recently announced a new law to increase prosecutions for domestic violence and she will personally oversea it. She also calls for anyone with 'quick wins' that could happen sooner rather than later. So I call for the Prime Minister to look at the register seriously the framework already exists and is called VISOR this should be opened out for serial stalking and domestic abuse offenders.
In my particular case, Smith had over 13 other victims (we know about), he had ruined their lives. They lived in fear in their own homes, were given panic alarms by police, had fast response markers on their addresses and one victim who I can now call a very good friend is and was at the time of the offending a serving police officer. If only the police had the power to track and monitor his behaviour. Maybe he would have changed his behaviour, maybe I would have been safeguarded. There certainly wouldn't have been the huge cost to the tax payer dealing with the fall out of all his offences. 14 lives we know about ruined along with police call outs, doctors visits, hospitals visits, operations, court appearances, local authority involvement, time off work, police investigations....and the list goes on. What do repeat offenders cost us?
