The Issue
TRUCKERS NEED BETTER PAY ON LOADS TO SURVIVE!!!
TRUCKERS ARE DEMANDING Secretary of Transportation to DELEGATE ENFORCEMENT of Federal Regulation 49 CFR 371.3, which is the PRODUCTION OF BROKER RATE CONFIRMATIONS with their customers, etc.
This impacts truckers who are now GETTING PAID SO LITTLE WE CAN’T MAKE A LIVING!! Hundreds of truckers are closing their company doors every day! IF YOU HAVE STUFF TO BUY ON SHELVES IN YOUR STORES…GUESS WHO BROUGHT IT?….A TRUCKER DID!!!….IF you want to continue buying stuff on shelves in your stores then you know how to accomplish this? SIGN THIS PETITION!
My company, Pink Cheetah Express, LLC, is the FIRST AND ONLY carrier in history, also female owned and operated, to have received broker documentation with the assistance from the FMCSA. Total Quality Logistics (TQL), the 2nd largest brokerage in the trucking industry had ignored my many requests and held back documents for almost a year until FMCSA demanded they turn them over.
TQL and many other broker companies are requiring Truckers to WAIVE THEIR RIGHTS to transparency by FORCING US to agree to these waivers as a condition to get loads in their contracts. We believe this waiver is UNLAWFUL evasion of regulation and may constitute UNREASONABLE RESTRAINT OF TRADE.
No wonder these brokers don’t want to turn over their documentation to let me know what’s going on because when I finally received TQL’s documentation….I LEARNED I ONLY GOT PAID 56% of the load!!!!! TRUCKERS CANNOT SURVIVE being paid 56% of loads!!! FMCSA held TQL accountable for the first request. Now I requested documentation for 15 more loads and TQL IS NOT RESPONDING AGAIN!! They are still holding back as if they didn’t get the memo.
YESTERDAY WAS THE TIME TO ACT! But you can join me today, right now and sign this petition requesting assistance from Hon. Secretary of Transportation Pete Buttigieg once again to ENFORCE this request ACROSS THE BOARD to every FMCSA office in every state.
RE: NCCDB Complaint number 100245807 (TQL)
The FMCSA's action in the TQL matter SET A PRECEDENT. Denials of my requests after that precedent could be deemed ARBITRARY AND CAPRICIOUS. SBTC advises me denials to other requestors would raise EQUAL PROTECTION of the law and DUE PROCESS issues.
STOP THE REGULATED (BROKERS), FROM REGULATING THE REGULATORS (FMCSA)!!
