The Issue

On December 16, 2025, a 12-day-old infant known as “Benjamin” was found deceased in Nampa, Idaho. This tragic loss has shaken our community and raised serious concerns about systemic failures meant to protect the most vulnerable. Public records and reporting indicate that Benjamin’s parents, Brian Lemke and Allysen Armenta, had a documented history of child abuse and neglect dating back years, including prior convictions and the termination of parental rights to other children. Despite repeated warnings from former foster parents and individuals familiar with the family’s history, this newborn was allowed to remain in an environment that had previously been deemed unsafe.

According to available information, multiple children were removed from this couple’s care in 2019 due to dangerous and unsanitary living conditions. Additionally, Lemke was reportedly released from jail in 2025 following a conviction related to injury to a child—only months before Benjamin’s death. Law enforcement reports further state that after the infant’s death, efforts were allegedly made to conceal what had occurred, and Armenta was later located while avoiding arrest on an outstanding warrant. These disturbing details underscore the urgent need for full transparency, accountability, and reform.

This petition calls on the Canyon County Prosecutor’s Office to pursue a thorough and vigorous prosecution based on all available evidence related to the death of Baby Benjamin and any actions taken afterward. Justice demands that no case involving the death of a child—especially one with such a documented history of risk—be handled lightly or without full public confidence in the process.

Beyond prosecution, we demand an independent investigation into the Idaho Department of Health and Welfare to determine how and why this infant was permitted to remain in the custody of parents with a known, violent, and neglectful past. Finally, we urge Idaho lawmakers to take decisive action by passing “Benjamin’s Law”—legislation that would require immediate review and protective intervention when a child is born to parents whose parental rights have previously been terminated. No child should fall through the cracks of a system designed to protect them. Baby Benjamin deserved safety, care, and a future. Idaho must do better—now.
