The Issue

WHEREAS the public roadway known as Zwicky Road was surveyed in 1915 and established in 1916 as a “Government Road 66 Ft wide” as per Plan #NEP 1326 of Subdivision of Part of Lot 875. G.I. – West Kootenay. B.C.;

WHEREAS Zwicky Road provides the only safe low traffic non-highway public access between the town of Kaslo and the sanctioned Wagon Road trail and the Mount Buchanan Recreation Area;

WHEREAS Zwicky Road is used year-round by community residents and visitors alike to access these areas;

WHEREAS denial of access to this public road significantly impairs our ability to travel directly and safely by legal motorized vehicles and other non-motorized means, prevents local organizations and businesses from offering their clients a safe travel link between recreational trails and the town of Kaslo, and removes the ability of residents to undertake their daily walk, mountain bike riding, horseback riding, cross-country skiing, snowshoeing, mushroom picking and other outdoors activities in nature, all contributing to the well-being of our community;

WHEREAS an individual has completed blocked access to the unconstructed section of Zwicky Road;

AND WHEREAS a landowner has filed a civil claim of ownership of an unconstructed section of Zwicky Road that is adjacent to their property that would grant them the right to control access of this section of Zwicky Road to the Wagon Road trail system.

We, the undersigned residents, and stakeholders of Kaslo, and the Regional District of Central Kootenay Electoral Area D (RDCK-D) of British Columbia, respectfully submit this petition to urge the Royal Canadian Mounted Police, Recreation Sites and Trails BC, the Village of Kaslo, and the RDCK, to recognize the importance of this unconstructed public right of way to the well being of the community of Kaslo and RDCK-D and take prompt action to have the road blockage dismantled and its continued access reestablished, ensuring equitable and safe passage for all affected parties.
