Push Pause on Provisions Seaside TGH
The Issue
Provisions Seaside TGH is carrying on an experiment that has never been tried before-an experiment that threatens our community and the welfare of the boys it has been entrusted by the State to care for. Provisions Seaside intends to house up to fifty (50) mentally troubled teen boys in five buildings immediately adjacent to each other and separated only by some chain link fencing. This is contrary to the very idea of a Therapeutic Group Home, which is designed to provide a homelike residential setting for these troubled boys. The close proximity of so many troubled peers will change the character of the neighborhood and defeat the purpose of placing the boys in a quiet and residential setting. Rather than feeling like a single family housing it will resemble an institutional setting.
Provisions Seaside TGH-1, located at 6321 Stratford Place, New Orleans, LA 70131, is licensed by your department to operate one Therapuetic Group Home for up to 10 boys. However, the renovation plan on the City'so permit website shows that they intend to open four additional TGHs at this 2 acre site: (http://onestopapp.nola.gov/summarycontent.aspx?type=pernit&id=537481
According to Louisiana Dept. Of Health Regulation Section 6201: "TGHs provide a 24 hours a day, seven days per week, structured and supportive living environment. The purpose of a therapeutic group home (TGH) is to provide community based services in a homelike environment to clients under the age of 21 who are determined to need psychiatric or psychological services."
For this reason, TGHs are limited in the state of Louisiana to no more than 10 residents. But Provisions Seaside is attempting to circumvent the intent of that restriction by opening five (5) TGHs on one 2 acre parcel. This will maximize their profits at the expense of their clients and the surrounding community. It would not be allowed by New Orleans' Comprehensive Zoning Ordinance (CZO) if they filed as a Group Home. Instead, they filed with the Safety and Permits Department as a Convalescent Center. In this way, they avoidea going to the Zoning Board for a change of use and variance.
If they filed as a Group home, Provisions Seaside TGH would have been required to provided public notification and receive input from the community impacted. As nearby residents, we never received any public notice. The first we, the officers and members of the Aurora Gardens Neighborhood Association, knew of Provisions Seaside TGH was when complaints began to come in. These ranged from nuisance complaints such as underage boys begging to get cigarettes from neighbors to serious criminal matters like illicit drug use, larceny, and assault. Many incidents have brought NOPD to this location. Which forces us to ask: if Provisions Seaside TGH cannot properly supervise nine boys, how will they manage 50?
We have been advised by staff members of Mayor Mitch Landrieu's Neighborhood Engagement Office, Councilmember Nadine Ramsey's Office and Council-at-Large Member Stacey Head's Office that we should pursue this matter with the appropriate local government departments. We intend to do so, but this will take time. In the interrum, we are petitioning the Health Standards Section of the Louisiana Department of Health with the following request.
At least until all disputes over permits are resolved, we, the undersigned members of Aurora Gardens Neighborhood Association, and others who are in agreementioned, ask your department to hold off issuing any additional TGH licenses to Provisions Seaside TGH, Seaside TGH BR RE 1 LLC, Seaside Healthcare, Inc., Pharos Capital Group, LLC or any of their subsidiaries or affiliates for any nearby addresses, in particular: 6301 Stratford Place, 6311 Stratford Place, 6331 Stratford Place, and 6341 Stratford Place.
