DEMAND JUSTICE FROM KEMPINSKI BALI FOR HUMAN RIGHTS VIOLATION DURING COVID19 PANDEMIC
The Issue
BACKGROUND STORY
My best friend (you may call her with Hani) is the 1st Female Aquarium Curator from Indonesia. As a professional, she has a lot of experience of it. She is a multi-talent, not only great as Aquarium Curator but also as Veterinary for aquatic, marine mammals and wildlife animal.
Furthermore, she has International certification for Fish Health and Water Quality Management and she able to design and to operate the Life Support Systems for Aquarium. This is an astonishing and rare skill for Indonesian women. She's been working not only in Indonesia but also overseas.
Her last project was Aquarium Restaurant at The Apurva Kempinski Bali Nusa Dua - Bali. It is the first underwater restaurant in Bali and it may be also the first open aquarium in Indonesia. This is the 1st seawater aquarium that designed and operated by Indonesian people, lead by her as Head of Curator
Even though nobody knows who the one behind this magnificent Aquarium is, the beautiful story of this aquarium has already been published in various international magazines and spread rapidly through social media. People who visit this Aquarium are amazed by this beautiful masterpiece.
HUMAN RIGHT VIOLATIONS DURING COVID-19 GLOBAL PANDEMIC
Unfortunately, the beautiful story vanished suddenly. She lost her job on 7th April 2020 after confronted with one of the Executive Committee on 6th April 2020 regarding General Manager Policy for reducing self-quarantine period for her assistant (you may call him as K) who just came from Jakarta. As we know that Jakarta is the epicentrum of Covid-19 global pandemic in Indonesia.
The quarantine period should be from March 27-April 14, but the Hotel Executive Committee reduced the quarantine period only until 7th April 2020 without any reasonable explanation.
Even though she had explained multiple times to the Executive Committee about the reason why she could not reduce the self-quarantine period and also the consequences, the committee did not listen to her. They insist that she have to follow the General Manager policy. It means, they have to disobey the Indonesian government & World Health Organization (WHO) policy regarding self-quarantine procedures.
As we believe that each individual has the rights to protect his/her life, this incident could be considered as an issue violation of human rights. She actually only aimed to do the right thing to prevent the spread of the virus in her workplace. She also has the right to stay safe from this Global Pandemic, and she has the right to protect her colleagues from this Global Pandemic.
The General Manager should be supportive and shows a compromise for this case. What makes it even worst is that she being reported to the police regarding this petition. This cannot be considered justice.
THE PRESENT CONDITION AT THE HOTEL
1. During 7th April until 20th June 2020, there were around 100 staffs who has signed 2nd phase work contract.
2. Then on 15th May 2020, all Moslem staffs received Eid Al-Fitr allowance.
3. Since 1st June 2020, the hotel has open for public and they already have guests after the re-opening.
4. On 10th July 2020, the restaurant already open for Public
THE SPREAD OF THE COVID-19 VIRUS AT THE HOTEL
However, based on Covid-19 Rapid test result on 19th June 2020, there are still some people indicated as reactive and it is including K the one who has reduced the self-quarantine period after returning from Jakarta and the most concern how if one has indicated Positif Covid-19. This Global Pandemic is not a myth because people are dying and Indonesia has been identified as a red zone.
THE IMPACT FROM THIS CONDITION
1. It's been 5 months (April to August) that my friend’s mother quits the chemotherapy for lung cancer since she don't have enough money to cover the expenses which are around IDR 50.000.000 - IDR 90.000.000/month.
2. My friend lost her credibility and the reputation she built for 16 year and this condition will give her problem to get new job opportunity in the future.
By means of this petition, we need legal assistance to fight her rights against the Hotel operator for Human Rights Violation during this global pandemic. Things we would like to propose are:
1. The Apurva Kempinski Bali management has to do Open Public Apology and giveback my friend job and her teams with the same agreement as before to refine her reputation.
2. Assurance a legal protection for the workforce and their family to get the comfort & safety of life so that they can do activities both in the workplace and in the neighborhood.
3. Ask the lndonesian National Commission of Human Rights to provide legal protection for the workforce and their family from threats and intimidation from other parties related to this petition.
By signing this petition, you will not only save my friend’s life but also you will save her mother’s life from lung cancer and the most important is you will save this hotel from the spread of the virus before this hotel turns as new cluster of Covid-19 in Bali-Indonesia.
