Tonight the Board will discuss an "INTRODUCTORY LOCAL LAW MORATORIUM ON BUILDING CONSTRUCTION," but guess what? Even if this law had already been in effect, it wouldn't have prevented the atrocity planned for 30 Sagamore Hill Drive.

Why?
Because this law would only affect R-1, R-2, R-3, & R-4 Zones. 30 Sagamore is an E-1 zone which is supposed to be for mixed use.**
Even if the law did affect the E-1 zone, which it does not, Section 5 offers a relief from the moratorium at the discretion of the BZA.
"Section 5. Administrative Relief from Moratorium
A. In order to prevent an unlawful taking of property and to prevent irreparable harm, the
Board of Zoning and Appeals (BZA) is authorized to grant limited relief from this moratorium pursuant
to the standards and requirements herein. An applicant seeking such relief shall be required to show by
clear and convincing evidence, including credible dollars and cents proof, that the applicant cannot
make any reasonable use of its property due solely to the moratorium; that the moratorium prohibits
fulfillment of the applicant's reasonable investment-backed expectations; that the moratorium causes
irreparable injury to the applicant; and that it would be unreasonable and unjust not to grant relief
from the moratorium. Any relief granted by the Board of Zoning and Appeals (BZA) shall be the
minimum necessary and the Board of Zoning and Appeals (BZA) may impose conditions on any relief
grant"

** Mixed-use - meaning business and residential mixed in one building. We all know the developer isn't acting in good faith when it comes to the non-residential part of this equation. It's a farce, and the Mayor, Trustees, and BZA know it too. Just look at 22 Sagamore Hill Drive. The residents showed up in droves at the those BZA meetings expressing their opposition to that proposed "mixed-use" building. The BZA didn't care. In fact, members of the BZA board shouted at community members at those meetings defending the developers. Here we are now with an oversized residential building on Manhasset Isle currently conducting an open house. Go see for yourself.
