I made this petition to make sure that I shed light on the injustice inflicted upon Mr. Simmons and the many other individuals that have been wrongfully convicted. This issue affects society and its faith in our judicial system, and we need change now! Please sign and share with others!

On June 28, 2006 a crime occurred on Detroit's eastside in an alley off of Chalmers, between Longview and Elmdale streets. A young man was fatally shot and killed at approx. 1:50pm/2:00pm. This was a Wednesday afternoon. It also was the day of the Downtown Detroit Fireworks Show. And we are seeking any information relating to the crime.

The victim was shot June 28, 2006 in an alley behind St. Juliana school. Maintenance men, school employees and some others discovered the body and called 911. Some of them gave statements. One witness (H.S) walked over to the scene and told the maintenance men, as well as some onlookers that he saw a guy get into a Chevy Caprice with a gun in his hand. That he saw the guy when he drove pass. However, the witness (H.S) did not tell the detectives what he saw. No one stated they saw the shooter.

July 18, 2006 a friend of the victim gives a statement claiming the victim and a guy name Paul was at her house and left together in Paul's car. Paul became the prime suspect.

August 1, 2006 Paul was picked up by DPD and questioned about the homicide. The investigator requested an arrest warrant for Paul. The warrant was denied due to lack of evidence.

October 24, 2006 (four months after incident) witness (H.S) gave his first statement to detectives. Though H.S states that he saw the suspect, and Paul was considered to be the prime suspect, H.S did not identify Paul.

The case goes cold for over three (3) years.

October 26, 2009 Paul is arrested for traffic warrants. A hold is placed on him for questioning (homicide).

October 28, 2009 witness (H.S) is transported by a Sgt. and an ex commander of the DPD to view a live lineup that included Paul. On the way to the live lineup, one of the officer's showed witness (H.S) a single photo of Paul. Once at the live lineup H.S identifies Paul as the suspect he saw with a gun in his hand, and get into a Chevy Caprice on June 28, 2006.

October 31, 2009 witness (H.S) does a deposition and gives a second statement. In the deposition H.S was asked how certain is he of the identification he made 10-28-09. In which, he stated 80% sure. Also, he was shown picture's of the said getaway vehicle (Blue Ford Crown Victoria) that Paul was driving the morning of the incident. H.S stated "that's not the car... not blue... it was a Tan Chevy Caprice".

November 2, 2009 Paul is formally charged with two counts of first degree murder and one count of felony firearm. Though at the time it was not known that the identification was illegal and coerced. The prosecutor that signed the warrant for Paul did know that witness (H.S) was Not 100% sure of the identification he made. Yet, he used that as probable cause to charge Paul with homicide.

No ONE identified Paul as the shooter.
No ONE was identified as the shooter.
The ONLY evidence linking Paul to the crime is the 80% identification by the witness that came over three years after the crime.
Transporting officer's showed the identifying witness a single photo of Paul while in route to the live lineup.

One of the transporting officer's, the ex commander of the DPD faced serious allegations of spearheading an entire homicide unit that practiced illegal tactics and procedures. He was brought on to work with the cold case unit as a "consultant". However, he again became hands on, actually working on cases such as Paul's case. Not "Consulting".

This petition will be sent to Gretchen Whitmer to bring her attention to this wrongful conviction!
