On November 29, 2014 my 7 year old son told me that he had been spanked 30 (thirty) times by his mother for lying. In April he told me that it was not his mother, but instead her husband, a 3x felon for cocaine distribution and burglary, who is the one who spanks him.

This is the first time since 2011 that I have heard those words. On that June day in 2011 I tried to take the matter up with my biological mother and her husband, only to be told to drop the subject, and then they ended my visits and reported me to the police for driving by my son’s home later that day. In July of 2011 I asked the authorities to investigate and was told to quit taking out my personal problems with my ex through the CPS system. I was arrested in August of 2011 in front of my kids at Whataburger for the charges mentioned above. My biological mother and her husband made the phone call to the police to have me arrested in front of my children.

Then worse events took place like my son telling me that he is around drugs, and like any good parent would do, I proved my son correct as I presented a positive drug screen from my ex-wives husband for cocaine and marijuana to CPS, only to be imprisoned for 173 days in solitary confinement for doing so. I was denied my rights to an attorney, denied my payment to the court for any back child support, denied my right to access the courts or a law library, denied a right and the actual Writ of Habeus Corpus hearing (my request was not filed within 10 days by the District Clerks office), and denied proper health care while in a box for 6 months, and of course all of this was without seeing my children. I have had to resort to petitioning the government before which resulted in a formal investigation into the corrupt Judge who allowed and orchestrated this denial of my own, my children’s and many other families' rights. On June 8th, 2015 I received a letter from CPS stating that a case has been opened on behalf of one of my children. When I called on the 22nd of June this case had already been closed after a “proper” investigation was done.

However, I am the only one who my son told this information to, and this occasion was witnessed by a Child Custody professional who provided a note stating as such. (which CPS has stated “could have been written by anyone and does not tie the note to the Child Custody Professional”, despite both of their names and addresses, without even attempting to contact the person who wrote the letter). Yet, CPS made only one attempt to contact me via a letter, knowing I was out of town receiving proper medical care in San Diego from the VA.

So in fact a proper investigation was not done AGAIN on behalf of my children and their safety. I even mentioned that I have all of my visits recorded with Audio (including my son telling me about 30 spankings, drugs, and guns in the home, my children forced to lie about home and punishments, and several instances where they are told that I am a liar and just want to steal them from their mother) and offered for CPS to review any of that, to only be told, NOT at this time, their case is closed. (June 22nd, and again today June 26th 2015)

With the signing of this petition, I am asking that the proper authorities will finally heed my warnings as a concerned father that when children are forced to lie to authorities and their parents then something is definitely wrong and should have all eyes on the situation. To do anything less is to deny my children their right to safety.
