Grant Grandchildren in England the Automatic Right to see their Grandparents.

The Issue

All over England, thousands of Grandchildren are suffering Mental Health Issues and Severe Stress due to being Alienated from their Beloved Grandparents, the majority of whom have done nothing wrong to elicit this Alienation, in most cases, the Grandparents are also suffering from Mental Health Issues because they want Contact with their Grandchildren but the Parents have Banned them from having that Contact.

As the Law in England currently stands, if a Grandchild is Banned by the Parents from seeing their Grandparents, the only recourse is for the Grandparents to take the Parents to Court to Sue for Access on behalf of the Child, which involves (1) Writing to the Parents to ask for Permission for the Child to see the Grandparent, then if refused, (2) Going to Mediation, which costs around £150 per Mediation Session, then if still unresolved, (3) Asking the Family Court's Permission to "Apply to the Court to Sue for Access", which costs a further £232, which can then be refused by the Court, and most Grandparents do not qualify for Legal Aid to enable them to take their Children to Court to regain Access on behalf of their Grandchildren.

This Process is lengthy, Costly, and very Stressful for both the Child and the Grandparent who then may find that they have paid out £382, to ask the Court's Permission to Apply to Sue the Parents only to have their Application refused by the Court, and that price is contingent on the Grandparent representing themselves in Court, the price goes up considerably higher if they choose to hire a Solicitor to represent them.

And even if the Application is successful and the Grandparents manage to win their Case on behalf of the Grandchildren, there is currently no Law in place to force the Parents to comply with the Court Order, which has caused many Grandparents to take their own lives.

This is a Breach of human Rights for both the Grandchildren and the Grandparents, banning Grandchildren from having Access to their Grandparents when they have clearly expressed a wish to see them is Cruel and Selfish, and a blatant Breach of their Human Rights, and while it is true that, in some Cases, the Children have reached out to the Grandparents once they were old enough to make that choice for themselves, sadly a lot of Grandparents did not live long enough to see that day, and for some Grandparents that day will never come, because some Parents have even gone as far as telling the Children that their Grandparents are bad people, or even that they are already dead, in an attempt to dissuade them from seeking Access to their Grandparents.

Grandchildren should be able to enjoy the company of their Beloved Grandparents without having to worry that their Access may be taken away without a moment's hesitation, simply because the Parents choose to Ban them from having Access.

I therefore Petition this Government to grant Grandchildren the Automatic Right of Access to their Grandparents, and to make it Law that if a Child wishes to have Access to their Grandparents the Parents must abide by the Ruling Granting that Access, and avoid an even bigger Mental Health Crisis as more and more Grandchildren find themselves Alienated from their beloved Grandparents.

With the NHS already stretched to capacity, they cannot afford for this Mental Health Crisis to escalate.
