The Issue
This petition is born out of a personal story that highlights an overlooked issue. Dr. Siavash Sobhani, a respected doctor in Northern Virginia, was born and raised in the United States. He has contributed to his community for over 30 years through his medical practice. Despite this, he finds himself stateless due to an often-overlooked rule that denies citizenship to children born in the U.S from families with political immunity.
Dr. Sobhani's situation is not unique; there are countless others who share his experience and live their lives in limbo because they belong nowhere legally despite being integral parts of their communities.
The Fourteenth Amendment guarantees citizenship rights and equal protection under the law for all persons "born or naturalized" within the U.S territory but excludes those who are "subject to any foreign power." This exclusion has been interpreted by courts and policymakers as applying to children of diplomats.
However, these individuals grow up here, contribute positively to society, pay taxes just like any other citizen but lack representation due to their status as non-citizens. They deserve recognition as full citizens with all accompanying rights and protections.
We ask Congress and relevant authorities for a legislative solution that would grant automatic citizenship at birth regardless of parental diplomatic status if they choose America as their home permanently.
