Immediately investigate violations by and clarify authority of the contracted dog control agency, known as Kent County SPCA, First State Animal Center & SPCA, Camden SPCA and Delaware Animal Care & Control
The Issue
First State Animal Center & SPCA (FSAC-SPCA)/Delaware Animal Care & Control (DEACC) (formerly Kent County SPCA and also known as Camden SPCA), has seized a dog, Millie, from her owners and declared her dangerous BEFORE the case has been heard by the Delaware Dog Control Panel. They are now charging Millie's owners with "Harboring a Dangerous Animal" and "Hindering Prosecution" prior to the panel convening. The hindering charge stems from the owner demanding the agency obtain a warrant (as required by Delaware law) to seize their beloved pet. The panel has not determined Millie to be dangerous.
Millie's personal veterinarian was refused access to Millie on Friday, March 27, 2015.
This is not the first, nor the only case of concern for many Delaware citizens.
However, KCSPCA/FSAC/DEACC's legal authority and questionable actions when seizing and housing Delaware pets has, once again, been called into question due to Millie's situation.

We, the undersigned, hereby demand an immediate investigation into the numerous violations and clarification of the actual authority granted under Delaware law and any federal laws of Delaware's contracted dog control agency KCSPCA/FSAC/DEACC, its Board of Directors, Executive Director Kevin Usilton, and Delaware Animal Care & Control officers for the case noted above and the below concerns:
• Repeated failure to comply with Delaware Shelter Standards Law, referred to by KCSPCA/FSAC/DEACC as "CAPA", whose executive director and staff continuously lobbies against as an "unfunded mandate";
• Repeated failure to comply with Delaware law to provide sick and injured animals with veterinarian care for diagnosis and treatment;
• Failure to comply with Delaware law to ensure kennel staff are duly authorized and certified to perform "euthanasia";
• Failure to comply with Delaware law to post found dogs in such a way as an owner could realistically identify as required by law i.e. no photo, breed misidentification;
• Failure to comply with Delaware law to timely post found animals as required by law in attempts to reunite lost pets with their rightful owners within the allotted "stray hold" period providing a financial incentive for KCSPCA/FSAC/DEACC to keep owners from finding and reclaiming their pets sooner;
• Failure to comply with Delaware law to adequately identify locations where animals are found;
• Failure to comply with Delaware law by consistently refusing to work with Delaware rescues to reduce the killing of healthy and/or treatable and adoptable animals since Delaware Shelter Standards Law was enacted;
• Failure to comply with Delaware law to maintain a Euthanasia Policy and Procedure Manual as required by Delaware law;
• Failure to comply with Delaware law to maintain clean housing facilities as evidenced by a recent outbreak of disease;
• Failure to follow a consistent fee schedule for the redemption of animals;
• Failure to properly train and certify dog control officers acting as officers of the courts;
• Repeated attacks against Delaware citizens and advocates through their places of employment and their pets for speaking out against actions, policies and practices;
• Repeated abuse of power by dog control officers and the executive director;
• Repeatedly using economical pressure by targeting lower income citizens and using intimidation and false information to force Delawareans to "surrender" their dogs.
