Yesterday, the attorneys of the first two Death Row inmates scheduled for execution requested a stay from the Arkansas Supreme Court. If denied, inmates Don Davis and Bruce Ward will be executed this Monday night. One week after their scheduled executions, the U.S. Supreme Court will hear McWilliams v. Dunn, an Alabama case arguing that defendants are entitled to independent mental health experts—experts that were notably absent from the cases of both Ward and Davis, who are thought to be afflicted with mental illness and/or intellectual disabilities themselves. Both men’s lawyers say that the U.S. Supreme Court should have a chance to consider this case before the Arkansas court decides on Ward and Davis’s executions. Back in Arkansas lawyers representing all seven remaining Death Row inmates are still fighting to block every execution planned for the ten day period beginning this coming Monday. Results from the federal trial are expected by end of day today.
