WE ARE GREATFUL to ANNOUNCE that my Henry's petition for DISMISSAL OF ENHANCEMENT AND RESENTENCING UNDER AMENDED PENAL CODE 1385 (SB 81) WAS ENDORSED AND FILED ON November 22nd 2021 and his HEARING was put on calender in the Solano County Superior Court Department 15 in front of Judge Robert Bowers for Friday Feburary 4th, 2022 at 8:30am. In addition an order was GRANTED for APPOINTMENT of COUNSEL.
Henry Don Williams was wrongfully charged with 187(a)p.c. 1st degree murder and 12022.53(d) gun enhancement in 2008. He was tried, convicted and sentenced of these serious charges in 2010. Henry has currently served 14 years on an extreme 50-to-life prison sentence.
Committment can be difficult at first but we understand how important that goal is. We want to thank Senator Skinner and Assembly member Lee for authoring SB81 and Govenor Gavin Newsome for signing SB81 Dismissal Of Enhancement Under Amended penal code 1385.
SB 81 sends a clear message to our courts: Let’s use sentence enhancements judiciously and only when necessary to protect the public,” said Sen. Skinner, D-Berkeley. “With SB 81, we can begin to reverse a stark racial disparity in California’s sentencing practices. Black Californians, especially, have been disproportionately targeted with enhancements that double the time they have to spend in prison.”
Judges currently have the authority to dismiss sentencing enhancements so SB 81 establishes guidance when a judge is deciding whether to dismiss an enhancement by requiring judges to give “great weight” to evidence that proves certain mitigating circumstances.
Senate Bill 81 requires Solano County Superior Court to afford my brother Henry to file a petition and prove to the court that he would not endanger public saftey if released because my brother has exceeded his time, and has met numerous mitigating circumstance. This petition is being expediently filed by Henry.
We are NOW! providing Solano County Superior Court with over 2,600 signatures of people who support and continue to support Henry and has followed Henry's journey to FREEDOM. Your voice(s) have been colossal in my brothers 14 year journey and pray that the decission makers dismiss this ENCHANTMENT.
