Mr. Henry Don Williams was charged with 1st degree murder P.C. 187(a) and a gun enhancement P.C. 12022.53(d) in the year of 2008 for the murder of then Fairfield City Councilman Matthew Garcia. Henry took his case to trial in Solano County Superior Court two years later and was found guilty, convicted and sentenced in 2010. Henry has currently served 15 years on a 50-to-life indeterminate prison sentence. On January 11th 2023 Henry filed a petitioners notice of motion for resentencing (Penal code 1172.5) and a hearing date was set for March 27th 2023 in the Solano County Superior Court Department 15 which will be heard by his original criminal trial judge Robert S. Bowers who actually voluntarily recused himself from Gene Combs co-defendant resentencing hearlng a few years earlier which was granted. Has Judge Bowers taken a personal interest in Henry's case? He refuses to disqualify himself to avoid not acting in a fair and impartial manner. Why? So when does the law overule Judges discretion? In Henry's Memorandum and Points and Authorites he states.." 1172.75 provides that [a]ny sentence enhancement (12022.53(d) that was imposed prior to January 1st 2020, pursuant to subdivision (b) of section 667.5 is legally INVALID, (1172.75, subd.(a).) It requires recall of sentence and resentencing of all persons in custody serving [*38] a term for a judgment that includes the repealed enhancement. (1172.75 subds. (b)(c) contains procedure's and DEADLINES for recall of sentencing of all such persons (1172.5 subds.(b).(e).) The latest deadline for resentencing is December 31st, 2023, (1172.75, subd.(c)(2)...Henry understands that 1172.75 does not guarantee a reduced sentence through the excercise of new amended statutes because the judge has discretion that triggers a remand to the sentencing court for resentencing. But Henry doesnt understand why it can't be heard in front of fair and impartial judge. WE NEED A CALL TO ACTION by calling, emailing or writing to support Henry by sending a clear message to Solano Superior Court Judge Robert S. Bowers to disqualify himself from Henrys and allow a impartial judge to take his place or resentence him. Henry is a accomplished author, songwriter, poet, recording artist and visual artist. During his incarceration he's obtained his A.S. Degree i. General Business and recently obtained his A A. Degree in Communications from Antelope Valley College in June 2022. His goal once released is to complete his education, acquire his Masters and given the opportunity to teach young students. Also during Henry's incarceration his publishing team established Moufpeez Publishing LLC because its a very important platform and viable outlet for incarcerated men like Henry and women to develope a way to change by healing, restoration, recovery and gaining insight about there crime, causative factors, taking resposibility, showing genuine empathy/remorse and most important making amends by telling there life stories and open conversation amongst the RIGHT decission makers.
