The Hearing Transcripts Reveal the Board Abandoned Neutrality

We’ve been sharing how the original charges failed every legal test. Today I want to focus on something equally serious: the hearing transcripts themselves show the Board did not act as a neutral decision-maker.
Virginia law requires the Board to function like an impartial jury. Instead, the transcripts reveal:
The Board refused to state the burden of proof when asked on the record.
Conflicted actors — including an Assistant Attorney General defending the Board’s prior actions in court, an Executive Director who had favored revocation, and prior adjudicators who had already ruled against me — were allowed to influence the process.
Board members used leading questions, interruptions, and a hostile tone more typical of a prosecutor than a neutral panel.
The Board preferred the investigator’s filtered notes over live testimony from the primary witness who was sitting in the room.
When that witness’s account collapsed under cross-examination, the Board ignored the contradictions and stuck with the original narrative.
This is not how professional discipline is supposed to work. A Board that abandons neutrality ceases to be a fair tribunal.
