A prática da FARRA DO BOI é considerada ilícito penal pela Legislação Brasileira, de acordo com o Artigo 3º do Decreto No. 24.645/1934 e Artigo 32 da Lei Federal No. 9.605/1998, em vista de promover maus tratos à animais. Artigo. 3º do Decreto No. 24.645 de 1934. “Consideram-se maus tratos: I: praticar ato de abuso ou crueldade em qualquer animal; (...) XXIX. Realizar ou promover lutas entre animais da mesma espécie ou de espécie diferente, touradas e simulacros de touradas, ainda mesmo em lugar privado. ” Artigo 32 da Lei Federal 9.605 de 1998 “Praticar ato de abuso, maus-tratos, ferir ou mutilar animais silvestres, domésticos ou domesticados, nativos ou exóticos. Pena: detenção, de três meses a um ano, e multa. § 2º A pena é aumentada de um sexto a um terço, se ocorre morte do animal. ” Entretanto, ainda em 2015 multiplicam-se os relatos de cidadãos – sejam moradores ou turistas em Santa Catarina – horrorizados ao testemunhar tal prática ilegal pelas ruas, sobretudo em Florianópolis e arredores. Comum no litoral catarinense, essa prática cruel e ilegal, é um costume trazido para o Brasil no século XVIII por imigrantes da região de Açores. Originalmente associada com a malhação de Judas, acontecia durante a semana santa sendo o boi símbolo do Judas que deveria ser punido publicamente. SUPOSTA TRADIÇÃO DISTORCIDA E CRUEL: ENTENDA COMO FUNCIONA A FARRA DO BOI Poucos moradores da região catarinense são adeptos da farra do boi e alegam que essa seja uma tradição regional. Mesmo assim, se em algum momento da história a farra do boi foi prática religiosa arcaica, atualmente é fato distorcido, inclusive pelos seus praticantes – originalmente o boi como símbolo do Judas era maltratado apenas na semana santa de páscoa – nos dias de hoje a tortura pública do boi acontece dissociadamente em outras ocasiões como natal, feriados e até casamentos ou campeonatos de futebol. A Farra do boi se inicia com requintes de crueldade dias antes de sua soltura pelas ruas: o boi é isolado e privado de alimento e água. Após dias sem comer, água e comida são colocadas próximas ao animal, mas fora de seu alcance, aumentando seu desespero. O animal é então solto pelas ruas onde “farristas” aguardam portando os mais variados instrumentos para ferir o boi como, por exemplo, pedaços de pau, pedras, chicotes, facas, cordas e lanças. É comum cortar o rabo do boi, quebrar suas patas e cornos, jogar pimenta em seus olhos, introduzir pedaços de madeira ou vidro em seu ânus, banhá-lo em óleo quente ou ainda encharcá-los de combustível e atear fogo. Durante a perseguição, muitas vezes o boi se atira ao mar, e morre afogado. Quando isso não acontece, a tortura pode durar até três dias, mesmo porque os “farristas” tomam “cuidado” para que possam aproveitar por mais tempo a “farra”. Somente ao perceber que o boi está próximo de morrer, os “farristas” o matam e dividem a carne. A crueldade costuma acabar com um churrasco. OMISSÃO DO CONSELHO TUTELAR: CRIANÇAS PEQUENAS ACOMPANHAM A TORTURA Apesar da prática ser ilegal e moralmente questionável, muitas crianças participam desses eventos, durante a noite, e são educadas a acreditar que essa pseudotradição é correta e não um crime. Em Santa Catarina há registros de menores levados à delegacia por flagrante de maus tratos durante a farra do boi. Crianças pequenas acompanham incentivando e achando graça na tortura perpetrada pelos pais ou cuidadores, em omissão severa do Conselho Tutelar que deveria zelar pelo bem-estar e desenvolvimento de crianças e jovens. MÁFIA QUE APÓIA E FINANCIA A FARRA DO BOI Muitos políticos, policiais e comerciantes apoiam, acobertam, se omitem ou financiam esta prática criminosa. Em geral, não há ação real da polícia nas ligações de denúncias. Quando eventualmente as viaturas aparecem, os policiais nada fazem. ESTAMOS EM 2015 E A PRÁTICA CONTINUA NAS RUAS DE FLORIANÓPOLIS AFUGENTANDO TURISTAS E ATERRORIZANDO MORADORES: PROTOCOLO DE COMBATE A FARRA NEM PARA INGLÊS VER! Nos dias 25, 26 e 27 de dezembro de 2015, no bairro Rio Vermelho, norte de Florianópolis, aconteceu mais uma Farra do Boi e, apesar de diversas denúncias e ligações para a Polícia local, NADA foi feito. Policiais alegam não ter o que fazer: desligam o telefone na cara dos denunciantes, justificam falta de viaturas, quando no local não fazem nada e questionam o que farão com o boi. Absurdo descabido haja vista que desde 2012 diversos órgãos federais, estaduais, municipais e ONGs, cientes do enorme problema, firmaram PROTOCOLO DE COOPERAÇÃO com normativas para atuar nos casos de FARRA DO BOI. Neste são signatários a Polícia Militar de Santa Catarina, o Ministério Público do Estado de Santa Catarina, as Secretarias de Estado do Desenvolvimento Regional, a Polícia Civil de Santa Catarina, a CIDASC, o IBAMA e o Instituto Ambiental ECOSUL. FARRA DO BOI É CRIME E A SOCIEDADE EXIGE PROVIDÊNCIAS! O descaso e a revolta dos cidadãos contra a Farra do Boi viraram notícia nas mídias sociais que, embora tenha recebido apoio de muitos, também gerou ameaças e xingamentos pelos simpatizantes da prática “farrista” criminosa. Precisamos de apoio da imprensa, ONGs de proteção animal, cidadãos que são contra este ato cruel. Precisamos dar um basta nesta tortura. THE practice of the “FESTIVAL OF THE OX” is considered criminal offence by the Brazilian legislation, according to article 3 of decree No and article 32 of FEDERAL LAW No 9.605/1998, in order to promote mistreatments to animals. This are signatories to the Military Police of the State of Santa Catarina, the Federal Prosecutor of the State of Santa Catarina, State Office and Regional Development, Civil Police of the State of Santa Catarina, CIDASC, IBAMA and the Environmental Institute ECOSUL. THE FESTIVAL OF THE OX IS A CRIMINAL OFFENCE AND THE SOCIETY DEMANDS PROVIDENCE The indifference of the authorities and the revolt of the citizens about the Festival of The Ox became news on social medias the although have received support from many, also led to threats and name-calling from the “revelers” supporters of this criminal activity. We need support from the press, animal protection NGOs, citizens against this cruel practice. We need to stop this torture. WE REQUIRE IMMEDIATE RESPONSE FROM THE PERTINENT PUBLIC BODIES AND ACTION PLANS TO CURB FURTHER ATROCITIES! Santa Catarina is rich in diversity, beauty and culture. Crime is no culture to be tolerated! Archaic practices should be reviewed periodically and should be adequate to the social reality. Otherwise we will be supporters of abominable acts by the mere fact of being ancient cultural practices, such as slavery, stoning and mutilation.
