Does a Chinese hold copyright on IU's songs?

It's not just IU's songs. The music copyright holders of YouTube videos that include songs of famous K-pop singers such as god, Toy, Younha, Brown Eyes are marked as Chinese.

This is a problem with YouTube's slack copyright management system.

Under the copyright law, YouTube, which is an online service provider, is obliged to take certain measures to prevent copyright infringement on its site.

However, even though YouTube has been receiving reports by users of the slack system that the "Content ID" has been issued not to the actual copyright holder, but to unrelated Chinese, YouTube is not explaining how the Chinese infringed copyrights or how to prevent recurrent violations in the future.

YouTube says that copyright holders can automatically protect their copyrighted works by setting their Content ID.

Regarding qualification for Content ID, YouTube Help describes that copyright owners have to give evidence of the copyrighted content for which they control exclusive rights.

However, the Content ID of K-pop sound source has been issued to Chinese people who had absolutely nothing to do with copyright holders.

And YouTube is silent about how the Content ID was issued to the wrong Chinese people, not to the copyright holder.

We, who LOVE K-pop and regard copyright protection important, request Youtube the following:

First, YouTube should explain why the Content ID was granted to Chinese people unrelated to the copyright holder, which could have caused copyright infringement.

Second, YouTube should conduct its own investigation and announce the damage caused by the current K-pop Content ID being granted to Chinese people.

Third, YouTube should disclose future recurrence prevention measures and take technical security measures.

아이유 노래뿐만이 아닙니다. god, 토이, 윤하, 브라운 아이즈 등 한국 K-POP 유명 가수들의 음원이 포함된 유튜브 동영상의 음원 저작권자가 중국인으로 표시되고 있습니다.

이는 유튜브의 허술한 저작권 관리시스템 문제입니다.

유튜브는 온라인 서비스 제공자로, 저작권법 상 사이트 내 저작권 침해를 방지하기 위해 일정한 조치를 취할 의무를 부담하고 있습니다.

하지만 유튜브는 “Content ID”가 실제 저작권자가 아닌 무관한 중국인들에게 발급되고 있다는 저작권 관리 시스템의 허점을 제보 받고도, 중국인들의 저작권 침해 발생 경위에 대한 해명이나 향후 재발방지 대책을 밝히지 않고 있습니다.

유튜브는 저작권자가 Content ID를 설정하여 자동으로 자신이 보유한 저작권이 포함된 저작물을 보호할 수 있다고 말합니다.

유튜브 고객센터에서는 Content ID 자격요건과 관련하여 "저작권자는 독점적 권리를 관리하는 저작권 보호 콘텐츠에 대한 증거를 제시하여야 한다."고 설명합니다.

하지만 K-pop 음원의 Content ID는 저작권자와 전혀 무관한 중국인들에게 발급되고 있었습니다.

그리고 유튜브는 어떻게 Content ID가 저작권자가 아닌 엉뚱한 중국인들에게 발급되는 현상이 어떻게 발생하였는지에 대해서는 침묵하고 있습니다.

우리는 K-pop을 사랑하고 저작권 보호를 중요하게 생각하는 사람으로서 유튜브에 요구합니다.

하나, 유튜브는 Content ID가 왜 저작권자와 무관한 중국인들에게 부여되어 저작권 침해가 발생할 수 있었던 지 해명하라.

하나, 유튜브는 현재 K-pop Content ID가 중국인들에게 부여됨으로 인한 피해실태를 자체적 조사를 실시하여 발표하라.

하나, 유튜브는 향후 재발 방지 대책을 밝히고 기술적 보안조치를 취하라.
