Globe Telecom Breach of Contract re: "Rubicon Plan" Postpaid plan
The Issue
Globe Telecommunication originally offered via a recorded telephone call their ubiquitously so-called "Rubicon Plan" at varying speeds. Petitioner subscribed to Globe Telecom’s 10mbps at 100 Gigabytes (GB) monthly data at Php 1,299.
Globe Telecommunications through their sales personnel specifically offered through recorded phone communication that once the monthly data allowance of 100 GB was fully consumed (capped) the speed will be throttled down to 30% of the bandwidth or speed which was 10mbps down to 3mbps.
To which contract the petitioner specifically agreed and subscribed to the plan or offering of 10mbps at Php 1,299 as when throttled down to 3mbps was still acceptable.
However, sometime in September 2017, Globe Telecommunication without notification whatsoever, no notice even in their webpage or social media page, no email or any official statement, arbitrarily throttled the capped speed down to 256kbps, in direct violation of the contract terms, by which in today's day and age is virtually paralyzing subscriber's access to the internet.
Calling Globe Telecom's Customer Service Hotline (02) 730 1000, the Customer Service Representative (CSR) acknowledged that there was a new instruction in which Globe Telecoms made an "alignment" of all the plans as they call it. Which only made it clear that Globe Telecoms arbitrarily made the change without even notifying or seeking consent from the consumers or subscribers.
Should Globe Telecommunication were to dispute this petition, they need only to pull-out the last audio recording between the petitioner and their sales agent or as they call it loyalty department agent.
Petitioner prays that Globe Telecom honor their contractual obligations to their customers. As this is a blatant act of deception to the displeasure of all the consumers.
Globe Telecommunications might want to consider that it’s not only the petitioners browsing pleasure is directly impugned here, but the several thousands of subscribers who earn their living through online jobs, or other consumers who employ Globe Telecom’s service for their small time business which largely depend on reliable service at intended speed.
