Support for Legal Action to Stop Illegal Dumping and Burning - Kya-Sands and Msawawa
The Issue
THE KYA SAND ‘BURNING WASTELAND’ COMMUNITY FORUM
Illegal Commercial Landfills operate openly at Kya-Sands and Msawawa informal settlements.
If you sign this petition, and provide your details:
- You are not committing to legal costs - our legal team are acting pro-bono.
- Your personal information will be protected.
- We will show the court (and possible Respondents) that we act for a significant number of concerned residents.
Illegal Commercial Landfills operate openly at Kya-Sands and Msawawa informal settlements. Up to 200 trucks per day dump waste, at up to 8 sites, ranging from household waste to rubble, industrial and medical waste. This waste is burned daily to reduce volume of the landfills and create capacity for more waste. Sites include the decommissioned Kya Sands Landfill and other illegally occupied land – including privately owned land, as well as land owned by the City of Johannesburg (CoJ) and Gauteng Province.
The Illegal dumping and burning of waste affects communities in the following areas: Bloubosrand; Cedar Lakes; Cedar Creek; Chartwell; Craigavon AH; Douglasdale; Farmall; Fourways; Hoogland; Houtkoppen; Inadan; Johannesburg-North; Jukskei Park; Kya Sand; Lion-Park; Maroeladal; Mostyn Park; Msawawa; Needwood; Nietgedacht; Noordhang; Pipeline; Riverbend; Salfred AH; Sandpark AH & Zandspruit.
We are engaging attorneys who have agreed to act Pro-Bono (without charge) in the Public Interest, in this matter.
Illegal dumping and burning is a cause of air, soil and water pollution. This pollution poses a serious risk to the health of our communities, and it is causing extensive damage to the environment.
These illegal activities are also supporting criminal elements which place the security of our communities at risk. Indirectly these illegal activities also influence the value of our properties.
The relevant authorities have failed to attend to these problems despite extensive engagement over several years. We will continue to engage with authorities, use the media and social media and lobbying to improve this situation
As a last resort we intend to take legal action against City of Johannesburg (COJ), Johannesburg Metropolitan Police Department (JMPD) and Pikitup.
The reason why we need your commitment is to show the court (and possible Respondents) that we act for a significant number of concerned residents and individuals.
In signing this petition you are confirming that you agree with the proposed action and the appointment of Keith Elliott to act on your behalf in any proposed action in combatting illegal dumping/burning in our area.
When signing, please provide your details, your personal information will be protected from disclosure in any litigation proceedings and/or court documents and will not be disclosed to anyone other than our attorneys, who are endeavouring to find a practical (and legal) solution to keeping everyone’s personal information strictly confidential. However, should any disclosure of this nature be required in due course, in order to successfully pursue any litigation proceedings, you will first be notified via e-mail and afforded an opportunity to withdraw your consent for the disclosure of your personal information, within a certain period of time. Should no objection to the disclosure of your personal information be received from you, you will be deemed to have consented to such disclosure.
The legal team will act Pro-Bono and you are not committing to any contribution to costs.
