Give parents Automatic 50/50 shared care of children if no safeguarding concerns UK

The Issue

Literally less than 60 seconds of your time could save millions of childhoods and people's lives from being blighted and ruined in the future, it could save children missing out on important occasions such as grandparents, parents, siblings birthdays, holidays etc, to save them being cut out entirely from one side of their family and all that family time that all children need, just because one parent wants to deny them that, just seconds to put in your name, please, for the children.

People going through this are not just statistics, they are not just people, they are not just court case numbers, they are something much, much bigger than that, they are a parent and their child or children!

Parents should get 50/50 shared care of their children without lengthy court hearings if no safeguarding issues & both families can provide care.

Currently I feel parents have to fight for more or even any care of their own children, using time & money better spent on the children, negatively affecting the parent & children.

Children can often be left out of the process despite being old enough, with a right to be heard & can be affected when used without penalty by a parent to cause pain, misery & abuse for the other parent, deeply affecting the children too.

I think it's a more equal starting point & automatic 50/50 shared care could help remove the ability to use children this way & the upset & conflict it causes.

The courts are supposed to follow the children's welfare checklist 1989 but often do not and just pick and choose what to use from a 'checklist', the children have rights given to them by that and by the UN Convention for Children to be heard, but despite being old enough and intelligent enough are  often completely marginalised, excluded and ignored when the whole system should be about the children, their wishes and feelings, what they want for their childhoods.

CAFCASS have a list of roles and responsibilities on their website, which they often do not fulfil, often leaving children feeling failed and let down.

If there are no safeguarding concerns, why should anyone have to go through the system anyway, in some countries such as Sweden they have automatic 50/50 and it works with great success.

In 2014 over 90,000 children had to go through this process, with their parents, extended families and friends, this probably affected over a million people, in just one year.

Never happened, Sir Simon Hughes was trying to get this into law when he was in government and because this was done to him as a child in the 1950's, it was happening long before then, and it's still happening to children today, the courts still failing children by denying them their right to be heard.

I think the current system is full of disparity, it is inconsistent, unfair, archaic, sexist, often favouring mothers when both parents are equally good.

Should having to leave a toxic and/or abusive relationship, or a relationship that has just naturally come to its end, having to leave your children behind, mean that you then have to fight to see your children too, with the children sometimes being used to carry on with the abuse?

I have adult friends, both male and female, that have mental health issues, regrets about their childhoods, have to have counselling as adults, just because this was done to them as children, some do not even keep in contact with the parent who did this to them, who does any of that really benefit?

This could be you and your children one day and wouldn’t it be best that if you did split up that you could do it knowing you will at least get 50/50 shared care without any lengthy court battles or conflict.

This negatively affects millions of people right now, childhoods blighted or ruined, parents suffering with depression and even taking their own lives and will continue to do so unless we make a change.
