The Issue

The bus driver should be reinstated because his actions were a direct response to an immediate threat posed by the teenager. The teenager had been verbally abusing staff and the public, and even escalated the situation by physically attacking the driver. In restraining the teenager, the driver acted out of necessity to protect himself, the staff, and the passengers from further harm. The driver's decision to intervene was justified, given the severity of the situation, and he should not be penalized for taking action to ensure the safety of everyone involved. Reinstating the driver would uphold a commitment to fairness, safety, and proportional responses to threats in the workplace
