Free Zachariah Anderson! Stop Prosecutorial Misconduct!
The Issue
In February 2023, Zachariah Anderson appeared before Judge Bruce Schroeder in Kenosha, WI, as the long-awaited trial to show his innocence was set to begin. Zach’s innocence was undeniable, and the facts proved this. However, the unthinkable happened on March 22, 2023, when the jury delivered a verdict of guilty of intentional homicide, hiding a corpse, and stalking.
Zach’s sentencing is scheduled for May 16, 2023. We are fighting to make sure Zach’s case gets a fair review and calling attention to the prosecutorial misconduct that we believe resulted in Zach being wrongfully convicted. We are asking the court to overturn the conviction and/or send the case back for a new trial, a fair trial, a trial without prejudice, a trial where the truth matters more than a win. Zach’s Case:
The Kenosha Police began investigating Zach in the disappearance of Rosalio Gutierrez, Jr. in May 2020. The investigation into Zach began with an individual informing law enforcement she suspected Zach to be involved, even though there is no factual evidence to prove the two had even met. The case against Zach was based on speculation and circumstance alone.
City of Kenosha Police, Kenosha County Sherriff, FBI, and numerous other Wisconsin Law Enforcement agencies put in thousands of man hours and copious amounts of money in attempts to find any connection that tied Zach to the disappearance of Mr. Gutierrez.
As a result of their extensive inquisition, they were unable to find any factual evidence that placed Zach at Mr. Gutierrez’s apartment. Why? Because it simply does not exist. There was NO DNA, NO Fingerprints, NO trace of Zach’s presence in the apartment. There was NO cellular data or GPS tracking that placed Zach at Mr. Gutierrez's apartment, and no plausible timeline allowing Zach to have any involvement, and not one single witness.
With the state having no physical or factual evidence that tied Zach to the disappearance of Rosalio Guttierrez, Jr., Kenosha County DA Michael Gravely invested more time in creating an elaborate fictitious narrative to charge, prosecute, and convict an innocent man. Mr. Gravely twisted circumstantial evidence at best (including a pinpoint spec of “inconclusive” DNA), and misrepresented facts to convince a jury of Zach’s guilt.
To say this is a miscarriage of justice is an understatement. I believe in a fair and just world, and I must believe people see the justice system for what it has become. Justice is not possible when the system, the system we are taught to believe in, deceives us. We must stand up for what is right. We must form our own opinion based off facts not spurious stories told by people in power.
Zach is now a statistic, but who will be next? There have been 25 exonerations of innocent people in 2023 alone, 234 in 2022, and 159 in 2021. What is happening in our justice system?
Fight with us, not only for Zach, but for Mr. Gutierrez. As long as the state believes Zach’s involvement, there will never be justice for Mr. Gutierrez. I am asking you to stand with us, fight with us, help us free Zach, get justice for Mr. Gutierrez, and show the justice system we still believe in and want the truth.

Michael Gravely, Kenosha County District Attorney, must be held accountable for his continuous abuse of power. A prosecutor's primary duty is to seek justice not merely to convict.
